So much of these infringments are AGAINST the law. But since there is no accountability among the "powers", its simply done to put money in the pockets until some one calls them on it. Of course the money stays in the pockets

I just drove thru a police stop check point today, They asked for insurance and Lic. I was shocked to see how many cars were being towed.

When i had my 240sx i drove thru one of those smog check ones. You can say no, I did they said thank you for your time and let me leave. I was stock but i was late for work. So i didnt want to do it.

Yup your 4th amendment grants you the rights against any "unreasonable" search and seizure. If the cop had probable cause he wouldn't need to request permission to search your car, he simply would just do it.

If you refuse to pop a hood when a police officer asks you, they can have the car towed at your expense and have it popped at a ref station. My friends have done this to numerous Hondas around here. They claim that their hood latch is broken or act like a smarty pants and say you don't have the rights to do that.
Why? Because the automobile exception allows police officers to inspect cars without a warrant or your consent as long as they have a probable cause. The probable cause can be anything from a loud exhaust, exhaust that blew out smog, or the exterior of the car is modified which leads me to thinking the car has engine mods as well.

They can also search your glove box and trunk if they think that you have a weapon in the car, as long as they have a probable cause. They can only search in areas that the item will fit in. They can not search your glove box, say if they're looking for a stolen TV.

If you get stopped at one of these smog stations, you can tell them you will be late for xxxxxx. They can not hold you there, but rather they schedule you in to go to a ref station. That will buy time for you to go back to stock, that or sell your car

Even though I have friends in the LAPD race division and some that are lawyers, the SoCal law enforcement makes it not so much fun to be a car hobbyist anymore. I'm tired of getting pulled over driving 40mph in a 35 zone while the SUV next to me was doing 50mph easily. This is why I'm just going to get a fast european car and keep it stock, lol.

The 4th Amendment unfortunately doesn't work when you are in the car on the road, because the automobile exception is a policy all by itself.
For those that don't know...here is what the 4th Amendment is in a nutshell...
The fourth amendment guarantees individuals the freedom from unreasonable searches and seizures.
There are 3 ways a search and seizure can be carried out:
1. The issurance of a warrant by a judge or magistrate
2. Based on police showing ‘probable cause’ for an arrest or for a search and seizure, and
3. ‘particularly describing the place to be searched’, and the specific ‘persons or things to be seized.’

Exactly, if there is probable cause he doesn't have to ask you in the first place, he'll just do it. I've refused multiple times, once with TPD who are known for racism and the cop didn't say anything but just nodded his head. I've also said no to the chp and the officer just lectured me on responsibility. And I get asked more often than normal to search the car, perhaps because of the fact that I'm young, in a nice car (Z06) and the registration is under my name. You CAN refuse, they ask you permission for a reason. Never had my car towed for refusing a search or refusing to pop the hood.

That site states just like I did, WITHOUT probable cause they CANNOT search your car.

Not the area that was setup on Barranca anyway. This was mid day and they were lifting hoods.

i hate irvine pd,
never been pulled over for no reason until i moved to irvine, pulled over twice for NO REASON, no tickets nothing, just wondering where i was going, coming from, etc etc, wtf!!! car is 100% legal, passes smog, etc...

anyhoo, this smog check thing is not mandatory

but as far as not popping the hood, that's up for debate,
they're suppose to have warrants for searche blah blah blah, however an exception is with automobiles, so that sucks for us...

Geez. Lifting hoods in the afternoon, checking DUI's in the evening. Must have been a slow month for them.

Looks like they're doing it in LA now. Po Po is sitting outside my office stopping cars right now. If you are going to head east on Culver just past the 90, think about another route today.

So if I have a loud exhaust and testpipe I can just refuse them at a smog checkpoint? I just say I'm very late for work/school/whatever?
