2003/2004 350z settlement notice from nissan
i just received a mail from nissan, offering settlement on 2003 and 2004 350zs, someone filed a case against nissan regarding front noise and front tire wear. anyone receive same notice?

I received it as well, but I didn't read it thoroughly. It said something about a law suit against Nissan Corp. in regards to unusual tire wear of the front wheels from an allignment issue that was not corrected before production. The late 04's (revised) were corrected with modified tires that supposedly balanced out this allignment. Then it goes into Blah blah blah details about how you qualify for this class action lawsuit.
Maybe I can post it up later when I get home so everyone can read it, even though it only applies to 03-04 owners.

Got mine yesterday, and skimmed through it.
I own a 04.5, and have had no problems so far, so I'm opting out.
But basically 03's get $250, and 04's get $150 in Nissan Dollars.
But certain requirements must be met, such as the owner having documented proof that they have had the problem worked on three times, and so on.
Best bet is to opt out of the settlement if you don't have any problems, so that when you do you keep your options because remember if you receive the benefits or do nothing you are saying that you are cool with having the problems on your Z, and will not pursue any type of compensation in the future. My advice again is to opt out keep your options open.
Also remember the dam lawyers are getting an uncontested 1.2 mill

Well I got mine and I have had the issue since nearly day one. I was told that they wouldn't do anything for me.. so I drove it till the tires where baloney.. and then I sat her.. for a year.. she still sits in my driveway..
The letter said that you had to have had it checked 3 times.. hmm if I had to get it checked 3 times.. I would be out of pocket because nissan said they would do nothing for me.. So i am f ed.. I am also NEVER getting another nissan.. *** hats..

-There is NO settlement yet. "The Court has scheduled a hearing for May 29, 2008, to consider whether to give that approval"
-IF it is approved, the settlement is:
1. Service Visit/Tire Discount Coupons (There's a lot to this one so read it)
or
2. Dealer Shopping Cards ($225 for 2003 -- $150 for 2004)
You can't have both.
You qualify if you are a current owner/lesse OR a past owner/lesse for 2003 & 2004. If the settlement is approved, a Claim Form will be sent out and you must return it by a certain deadline.
Everyone's situation is different so read your notice in detail.
It does NOT matter if your car is modded or not, as long as you can show with documentation that you experience these problems...at least 3 times. Here's some concerns that I have with some of the verbage used.
For the Serivce visit/Tire discount it states:
"Nissan will send you a Service Visit/Tire Discount Coupon if you meet the following criteria: (a) you are experiencing tire roar or tire growl in your 2003 or 2004 model year 350Z: (b) you had....."
It list up to three criteria. When they state "if you meet the following criteria" do they mean ALL three criterias or just one? 'Wouldn't it be more clear if they state if you meet "ALL" or "ONE OF" the criteria?
The settlement only states "...tire roar or tire growl..." How about people like me who really don't have these noise BUT DO have tire wear? Tire wear was mention in the begining.
(The plaintiffs allege that Nissan designed and manufactured the 2003-2004 Nissan 350Z vehicle with a defective front-end suspension that causes uneven and accelerated tire thread wear and tire noise in the form of a tire roar or growl.)
Ok, so the problem of uneven tire thread wear is known, but when it came to the settlement, ONLY the noise is address. You can argue that you can't have one or the other, but let me tell you that lawyers write EVERY word with a purpose.
When I take my car the dealer, they will argue that the settlement ONLY mentions the noise, and not the tire wear. Since my car ONLY has tire wear and no "roar or growl" I will not get the benifit.
For the shopping cards it states:
".....you will receive a $225.00 Dealer Shopping Card from Nissan if you have, at the time of receipt of this Notice, had (a) three (3) sets of front tire replacements with appropriate contemporaneious documentation of a tire noise complaint by the tire vendor or servicing Nissan dealer, and...."
I don't have much of a hard time with this cause I can see where Nissan is comming from. But I have gone through three sets of tires, however, I never made any formal complaints, thus I have no documentation and therefore no $225 for me.
I am one of those people who feel that Nissan did try to please it's customer and did some things right. However, when my 2003 Z has more problems than a 1990 Honda Civic with 150K miles, something is wrong.

I got my notice yesterday too. I'm not going to bother with it. Seems like too much of a PITA to deal with all of this for $225...that's the price of only like 1 tire lol.
