well when i got it installed i had to sign a waiver so the place who installed it isn't liable. besides all that nobody should have been messing with my remote...all they have to do is press unlock or lock. one or the other.

That letter of "no liability" means nothing in a court of law....if you want it to get that far.....

You let them know about the auto-start, correct?

If so, it is negligence on their part. You weren't there, you left specific instructions of what to do, and they screwed up. Don't let them worm their way out of their own stupidity, they are completely at fault.

Get a hold of Jason at Performance Nissan. mynismo.com They did the exact same thing over there with a customers car and they took care of everything. I would ask him what you should do.

thank you so much bro...ill give him a call tomorrow. man i feel like **** cuz i haven't even made the 4th payment on the car yet and this already happened. honestly i do feel that they did it on purpose because in order to push start your car, you have to push the button 2 times. and they should clearly be able to see the lock and unlock symbols and not even mess with any of the other buttons. im just so pissed off right now. should i let my insurance company know or should i wait to get a response from nissan?

Get a response from Nissan first. You still have a little time before the insurance company needs to know. I would be trying to figure out a way to be getting a completely new car though if I were you, if the damage isthat bad. If there is going to be cutting, welding, and pulling then I would ask for a new car as yours will be officially tainted.

Sorry to heart that man. How bad is the damage? Any pics? How are the handeling the other cars that were damaged? In my opinion if they are going to cover all cost of the other cars then they should cover yours too. It's just like if they were driving and hit another car.

damn that freaking sux, kinda makes me mad.

i met a guy awhile back who said he worked at the baker jackson nissan, and he told me whenever they have a z in for service, he would go for a joyride with them after the service is done. i guess they have take it out to make sure everything is ok, but you can imagine how they can abuse your car though. i'm staying away from that place for sure!

man those bastards have the odasity to even tell me that I'm gonna be responsible for the damages? I gave my lawyer a call and he said the worst that could happen is that I'll be liable for 50% of damages but he said that he's 95% sure that we can beat them...considering that I wasn't there and that I did tell them about the remote start...and that you have to press the button twice for it to start...and that the car was in reverse and the emergency brake was down...what kind of lousy service is that? I haven't seen the car yet...tomorrow I will, and take pics for insurance purposes and for you guys. Wish me luck guys...and if anyone has any ideas or knows anyone that can help me out, please let me know

Before I left I made sure to disarm my Clifford RSX 3.5 alarm w/push start. I told the advisor just unlock and lock...don't press any other buttons. Well I got a call this morning (monday) from Baker Jackson stating "your car just sideswiped 2 other cars"...I was like WHAT THE ****!!!!!!!!!!!!!!!!!!!!! I said I told you not to press any other buttons but lock and unlock. Theres no way the car would start unless you press the push start button twice. So someone tell me if you think they did it on purpose or they did it unintenionally, reason im asking is because the gm thats been there for "3" years states he's never seen an alarm like this. I told him I don't care if you've spotted bin laden, thats my toy and nobody but me should be messing around with the alarm. He said that he needs to call the stereo shop that installed my alarm and ask them who would be responsible, i told him that their not going to fix it because if your car is stick they make you sign a waiver. Now I understand that if I push started it and it launched, I would take the blame but since the dealer did it THEY SHOULD BE THE ONES PAYING. I sware to god they better have my ride fixed or else im gonna go there with my lawyers, sue them, find the technician who push started it...AND LYNCH HIM!!!!!!!
well it sounds like you have a 6 spd car and if so . watch how you handle things. its against the law to install a remote start on a 6spd car you might want to take things slow. its your fault no matter how you look at it..

getting rude and threatening would get you nowhere. just be polite and persistant.

but really if they say no, then you have no legal recourse as you broke the law installing it (and what happend with your car is the reason that law is inplace)

Damn, that sucks, man; hope you come out on top.

In the meantime, a few points to consider:

1. having a rig like that in your car and leaving it in the hands of a dealership over the weekend is just asking for trouble.

2. telling someone "don't touch any other buttons!" is kind of like telling a 5yr old not to shove that jelly bean he's been playing with up his nose.

3. picturing one of the dealerships "genius" techs or porters pressing buttons randomly on the remote like a monkey somehow does not seem like that much of a stretch of the imagination to me...

Cardinal rule here: if you have anything installed in your car that you feel it neccessary to eplain to someone, EXPECT it to be screwed with when left unattended.

Probably not a good time to ask but if you get rid of the Clifford let me know, I have an auto z and I have been looking for an alarm. Also I had a Honda that had remote start and the moron at the dealer left it in gear and the exact same thing happened. I ended up having to pay for my damages but luckily the 3 cars it hit they took care of through their insurance. Hope everything turns out ok. Good luck.

well as of now it looks like I'll be paying for the damages done to my Z and the dealer will be paying for the other parties vehicles...not my favorite solution but better then paying for all 4 cars. good thing its just minor paint damage and luckily i have a good painter who doesn't report damages to car faqs. i most likely gotta get the whole right side redone...aint that a mother ****er?

hey its just a thought but try saying to them that they should have pulled the hand brake... bc if they were to have pulled the hand brake the engine would have died right away...
