Fighting for rear tire replacement now

Well when the local Nissan dealer realized he had to replace my fronts...I asked him to check out my back tire due to the fact that people are having problems with all four tires wearing out quickly. Now here's a dealership that doesn't even do alignments and I don't know this guys auto background, but he tells me "they are fine and no problem".
Today my car is getting the front tires done finally so I decided to call the pros up there that they outsource their alignments to (Pat and Reds in Bartonsville) and ask them how my back tires look. The dude tells me that as they were replacing the fronts they noticed that the rears were very worn also and suggested that they replaced as well...hhhmmm...so why did the nissan service manager tell me they were fine?
I already called NCA and left my representative a message about the situation...and left a message with the service mngr at Nissan to call me back..he just called and said he hasnt' been able to get approval for 4 tires on any other car he did....funny, he told me he couldn't get approval to do ANY tires to start with. So I told him we'll see what happens and now my car is half done. Just doesn't seem like a very helpful guy. Reset my tripometer, tripmeter in the gauge and recoreded the odometer...so that may be a whole differnt post later on!
So now my back tires are really worn out....do I have a case to fight for replacements for backs too? Did the rears get worn out because the fronts were very worn and misaligned? Just wanna get my facts straight when I start arguing with Joel at Abeloff Nissan.
EDIT: Joel called me back to tell me that Nissan Waranty Dept. will not approve back tires...he told him the wear is 3/32 and Warranty told him to do nothing...I guess I gotta ***** and complain. How did some of you guys get all 4 replaced? How could Nissan NOT replace rear tires that are quickly worn out also? 9000 miles and they are worn?!?!?!
