3/32 tread left at 9500K = excessive wear?

I'm trying to get the back tires replaced but the Nissan service guy told me that Warranty denied it. The service guy told me that there's still 3/32 tread left.
Is that alot of tread? Is that excessive wear for only 9500 miles?
Just tying to get my facts straight for when I have to argue this.

fawkers...I don't even do any burnouts!
But can I argue that 3/32 is alot of wear for only having 9500 miles on the car? Would the front being misaligned cause wear to the rear?

I really don't know how much 3/32's worth of tread is. I can't picture it in my mind, but it doesn't sound like a lot of tread left.
Misaligned fronts shouldn't have anything to do with the back tires, but I'm not an expert on that type of thing. I'd take the car to a professional tire shop and get their opinion on it. See if they can find any rear alignment issues that could cause this and if so have them write up a document stating that.
