Default A motorcycle fell on my Z yesterday!

so when i walked out the door this yesterday morning and i see my neighbors motorcycle laying on my left quarter panel... i was preying that there was no damage, but unfortunately there’s a huge dent on my car. btw, the bike fell due to heavy winds. so i got a police report done, but the cop was like "act of god" insurance is not going to cover it... so today i go talk to my neighbor about the accident.. i was trying to be as nice about this as possible... "Hello my name is Yang, your bike fell on my car yesterday, i'm sure your wife told you what happened. (pause) Well there’s $664.51 worth of damage done and i would like to take care of it asap." so he's like "i'll give you my insurance info 2morrow" he didn't even say i'm sorry for what happened... what a fu#ker! cuz he knows his insurance won't pay for it cuz its an act of god... and if i go through my insurance i have to pay a 500.00 deductible and of course a increase in premiums.
any thought on this matter?? i'm in need of help.. i can't sleep at night and my grades are dropping...
also anyone know a great body shop in central jersey?

Well technically it's a collision cause by his motorcycle not being "secured", just like if you left your car parked with no parking brake and it rolled into someone's car.

In other words, he crashed in to you. His insurance will cover it considering he's accepting blame. It could fall under "act of god" but that would be your insurance covering it and with YOUR comprehensive deductible. Get that beotch to cover it. Why the hell was it parked so close to your car that it could fall on it anyways?

That sucks Yang. It was pretty windy outside yesterday. The bike should've been secured.

i park next to the bike cuz bikes don't have doors... therefore less chance to get a door ding.... this accident changes my whole perspective on things.

This is a tough situation, I'm sorry to hear that your Z was damaged, but I really don't think it is the bike owner’s fault! It's no different than a tree limb falling and causing damage....and most likely your comprehensive coverage will cover this!

Isn't that how it always goes? You take extra care to protect the car, only to find you simply can't win.

Since it was done on private property his insurance company won't accept liabilty for the damages. Your insurance should not be able to raise your rates because of this. They can only raise rates due to a collision where you are at fault.

As much as I love my Z, I wouldn't go after the owner of the bike if it fell on my car. It wasn't his fault. Sucks, but **** happens.

That's a tough break...

I'm not sure what I'd do.

If the guy had his bike parked properly, then I guess it's just tough luck.

I'll be interested to see what the insurance companies do for this one...

I had an airplane tied down in a row with other planes. Tornado lifted my plane up, flipped it upside down on top of another. Both planes were totaled. In a lawsuit, we had to pay for destruction of the other plane. Court did NOT attribute it to an act of God.

Go after the motorcycle owner. His insurance should pay.

I agree, his insurance should cover this.

Offer to him to claim it on his insurance and if he refuses then proceed with the small claims approach.

I'm a claims adjuster & sorry to tell you, but his insurance will not cover it. He would have to be liable in some way for them to cover it & an act of God does not fit it. Looks like you'll have to file a comp claim under your own policy. Now your rates may not increase. Some insurance companies look at how much they pay out on comp claims to determine if there is going to be an increase in the premium. It all depends on what your insurance company does.

Anyway, good luck with everything.

p.s. keep in mind, Jersey may have different insurance laws as well.

Since he gave you his insurance then I would proceed with pursuing it there first. If it doesn't work out with his insurance and you end up filing it on your insurance then make him pay the deductible, if he doesn't take him to small claims court.
My angle with his insurance company would be that it fell because it wasn't secured properly. Don't say $hit about high winds.

I agree, don't say anything about wind. Just say you walked outside in the morning and saw it lying there on your car.
