Default Insurance... [venting]

Got a letter in the mail today... was found 50% or more at fault for an accident on August 28th... gonna cost me blah blah blah...

Accident in question: Going around a left curve in the road and there is a road hazard (think it was a box). I swerved left to miss it and swerved right to avoid oncoming traffic... no accident. It turns out my passenger had a weak neck from a past injury and it hurts again... so she puts a claim into the public insurance company to get physio therapy. They have denied her claim and have proceeded to find me at fault...

They know what actually happened as I submitted a statement earlier explaining what happened.

I'm sorry... what did I do wrong? Would they have preferred I just hit the box which could have had anything in it... or would insurance prefer I get in a head-on collision... yes... extreme options, but I'm pissed... this goes on my record for being at fault in an accident now...

You didnt take her out enough, hold her, listen to her, deal with her kids in a consistent manner, two minute nut, diamond too small, or any other combination of things.......as far as the finding, I think thats pretty much it.

That's messed up on your friends part.

Can she prove that it was your driving that did it?

How do you know that she didnt sleep funny one night and got it?

I have a couple bad disks in my back, and I couldnt imagine filing against a friends insurance if it acted up because he avoided an accident....

I surely wouldnt let that chick in my car ever again.

Talked to my insurance broker tonight... he thinks I should be able to buy back the claim for a minimal amount and not have it on my record.

I made a statement cuz I'm a nice guy... damn it... and wanted her to get the help she needed if she needed it. I thought it was going to cost me a small surcharge on my driver's license.... turns out I was mistaken.

As for her... she WAS like a buddy... didn't think I needed to wine & dine her... So I'll get this settled and never let her into my car again... I'm staying as far away from her as possible.

why didnt u just lie and say u dont know her, or she was never in your car.... dont forget it was just the two of you, and its her word vs yours.

I think it was supposed to be a joke regarding insurance policies in Canada, not the quality of the people. I don't think any insult was intended.

I don't know if the same scenario is possible in the U.S. or not.

Why did she file with auto insurance and not with health insurance???

And did she file with YOUR auto insurance?? And how did she do this? They cannot simply up your rates since you did not get a ticket or cause a wreck, thats insane!

Im really confounded by how this is set up, maybe its just very different there.

But if a friend was in my car, and hurt her neck and there was no accident (no damage to my car or tickets issued) then she would have to file it with HER health insurance, sorry. And of course my auto insurance would deny coverage, but they could not say I was at fault...

what if she saw some hot stud guy walking down the road, turned her head and hurt her neck that way, would it be my fault then? No, she needs to go see her health insurance, and you need to have your auto insurance cancel all that crap since you had no accident and you were not at fault. If the cost is high enough talk to a lawyer... jeez... insurance...

Wow, another reason to never do anyone a favor. I think from now on, I will not give anyone rides in my car that is not related to me. I will also bar entry to my home because I'd hate for someone to trip on my carpet and mess up their neck. What a bunch of BS.

You should definitely have the passenger retract her claim. If she fails to do that, make her pay the difference in your premium. If she doesn't do that, then retribution is in your court. I'll let you be the creative one.

As for the insurance claim, I am (again) appalled by the fact that they denied the claim AND are planning on raising your rates. So, no money goes out of their pocket, but more money comes in. I really hate insurance companies, and that's why I only carry liability on all of my vehicles except for the Z.

In the US an individual can’t arbitrarily file a claim against my insurance policy.

And I'm sure there are 'scamming chicks' in Kansas, but none ride in my Z.

kcobean; no it wasn't a joke. If that's the 'law' in Canada, it's stupid.

What exactly do you mean by "public Insurance" ? Are you insured through a state sponsored insurance group? Or "pool"?
