Cool I fought NISSAN and I.......

WON!!!!!!!!!!!!!!!

I have been through 3 trannies so I decided to file suit against Nissan 1.5 months ago.

Lawyer called today saying Nissan has agreed to pay the remainder of my loan AND all of what I have paid into the car minus 18 cents per mile!

Is this a good deal?

I AM HAPPY ABOUT IT!

Hold up....18 cents a mile is over $7,000.00 to me. Someone explain to me how this works again..stupid lawyer got right off the phone!

Hmm at 40k miles, not such a good deal. Maybe 10 cents a mile, then it would be a decent lease.

I think its every penny I paid into the car including interest minus .18 cents a mile.

So I would still come out up money. My other option is to keep the car as-is and take $5,000.00

This sounds like a settlement based off the Uniform Commercial Code's laws for non-conforming goods (aka bad car).

That is to say,
pay the remainder of my loan AND all of what I have paid into the car minus 18 cents per mile!
They are paying you the difference of what the car cost at the time of acceptance (purchase) and the value of what ever repairs you made (incidental/consequential damages) minus the amount or value of any benefits received by the you directly or indirectly, (use of the car) ergo 18Cents a mile.

Like someone else said, see if you can negotiate the 18 down to 10 cents... 18 is pretty damn high. Also, I wonder what a current estimate of the value of your car is in consideration of those 3 repairs.... Keep us updated.

I wonder too?
Im not as exited any more. I will call the lawyer first thing tomorrow and let ya know. But I believe I will be getting ever dollar I ever paid minus the 18 cents as it stands.

I am very happy for you and as long as you are not losing any money it is a great deal. Nissan is at fault in this situation and being that they made you that offer reaffirms this fact. If they were really doing the right thing they would pay the remainder of your loan and also make you a great deal on an 05 model,by taking off at least 5 to 7 thousand dollars off invoice price. YOU DESERVE IT , FOR ALL OF THE HEADACHE THAT THAY HAVE PUT YOU THROUGH.

Definitely, you must be practical ,but you have been taken through alot and Nissan should deal with this knowing that fact. They should be willing to do anything with in reason to make you happy. You were going to pay your loan off over the course of time anyway, so a billion dollar company paying your loan off is nothing. They should compensate you to your standard of choice not there's. But as long as you think it through, I am sure you will be making the correct decision. But all in all ,this is great news to hear that Nissan as acknowledged your problem and are willing to attempt to rectify it.

Hey do you think I can sue ...I ordered a Nismo spoiler and they ordered the wrong one and now I have RS spoiler on my car and thats not what I ordered?

Nissan is to pay all the Lawyer fees.

As far as not posting info on here I know there is a danger of defamation but I trust most everyone on here.
Still thanks for the advice...mind if I ask what part of Scottsdale you live in?

Be careful of the dealers actually going on these forums and monitoring people except for of course Performance Nissan. When I was in SCACGP one of the club leaders modded his GTP and demodded when he took it to the dealer. The dealer knew exactly who he was and voided his warranty.

yeah but I really have nothing to worry about in this case. Nissan is totally in the wrong. My car is just about BONE stock.

NOTHING I have on that car voids the warranty.
Appreciate the heads up though
