I live on a steep, very steep hill with a steep drive way. I put it in first gear, put the emergency brake all the way up, get out and put 2x4 wood under the back 2 tires and attach a chain to the front tow latch and connnect to my moms Expedition.

I always use the handbrake, and always leave the Z in gear......I also make sure, (when I remember to), turn off radio and a/c before turning off the ignition....just a habbit....Dave

i once parked on a REALLY REALLY REALLY steep hill in the z and i pulled the parking break all the way up and the car still inched back. So i put it in first (like always do) and it was ok. I came back 2 minutes later and moved it just to make sure.

I put on the e-brake, turn of the car, and leave it in 2nd no matter where I go (except when parked on slope facing down than I shift into R).
desiguy, I think you need to calm down and rationalize the situation. What would have happened if the service guy did not place it into gear and leave the handbrake off like you do, and the car was to roll and hit something? It seems like the dealership/service guy is in a no win situation.
I understand that you are used to getting in the car and not worrying about it being in gear, but you failing to check and hitting something does not constitute the dealership having to pay for this accident.

In any case, the reason why I ask is because I was at the dealership today to get my oil changed and the mechanic left the car in first when he turned off the car. I get into my car and started in up and didn't realize that it was in first. So when I took my foot off the clutch, the car jumped. Luckily, the car was parkd right next to some rocks in the nissan parking lot and guess what, my front fender got damaged! I talked to the general mgr and he told me that since I drove it, it was my responsibility. My response was that I gave the car to them in a certain way and I expected the car back in that way, ie turn the car off and keep it in neutral, plus the car was parked right near the rocks and they were negligent in those aspects and they should pay for it. Long story short, he tells me he will split half and said he would have his guy charge 800..ie i pay 400. I shoped around this afternoon and I'm quoted 300-400 for the job. Mind you, this is not a major dent, or anything..just some scuffed paint and what not.
I guess my next question is what should I do about this? It seems to me that the gm is tryin to pull one over me and overchargin me so that he would not have to pay. Should I use my guy and send him the bill for the other half? Contact Nissan customer service?

Wow ... I always wondered why they put automatics in sports cars, after reading this thread, now I know why. Some people do not have common sense to drive manual transmissions.
ALWAYS put the car in 1st and use the hand brake. Regardless if the road is flat or not, this way you will be in the habbit... The problem with not putting it in 1st gear when parking on flat streets is that you will get in a habbit of doing so and could do it on a inclined street, where your emergency break could go out and your car could cause some serious damage if not actually kill someone....
Im surprised the GM even agreed to pay anything, this was your fault for not checking what gear your car was in when you started it. Everytime I get into my car, i throw it into neutral before starting. This should be a HABBIT for anyone who drives manuals...
