Default is this a scam??? please respond

I know that i am posting in the wrong section, but i need a response tonight. I ordered brake pads on ebay and got this message in return. This guy has a good feedback rating, but I don't know too much about breaks and dont know if i am getting screwed or not. Any feedback is appreciated.

Hey Andrew, thanks for bidding, we appreciate the business. I have a bit of
somewhat bad news... We've been selling these pads on ebay pretty constantly
for the last couple months. We are now getting some sets returned as the rear
part # D 1509 RU is not fitting properly. After a long run through with the
manufacturer in Australia, we have found that the pads were mis-boxed by them
and our entire batch of rear pads is actually the Ultimate pads that are
supposed to fit the 350Z WITH Brembo Brakes. I know that this auction was for
the w/out Brembo models. We found this out, but it was already to late to take
the auction down, so we are waiting for it to end and hoping there were no bids.

Anyhow, since the pads are made in Australia, we are looking at another 2 months
before they arrive to us by boat. I assure you that, we are not a company that
puts out of stock auctions on ebay, this was purely an error on the
manufacturers end and it was too late for us to take this particular auction
down. So I have a couple different things we can do.

1) We do have the correct FRONT pads for the Non Brembo Brake 350Z. We also
have the Akebono Ceramic pads (Which are in stock and are for sure the correct
fitment for your vehicle) for the rear, which are virtually the same compound
as these Ultimates. Our cost is much more on them, but since that is not your
problem, we can send out the rear Akebono Pro-Act Ceramics and the Front
Ultimates at the same price you already paid, and we'll eat the cost.

2) We can wait for the rears to come in - but this would be about 6-8 weeks.

3) We can just send the fronts and refund you half of the money you paid.

4) We can refund all of the money and cancel the order, no questions asked.

5) If by chance you have the 350Z WITH Brembo Brakes, we can send you the
correct front and rear pads Ultimate pads.

Hawk HPS Brake pads are $61 at www.tirerack.com

respectable store and great pads.

I would skip the ebay pads. No idea of the quality you'll be getting. The Hawk HPS pads get very good reviews here.

From what I read the seller wants to make it right. So it's up to you. Just get your money refunded, and buy elsewhere.

heck, i think he's being pretty standup about the problem by giving you more expensive pads. But, yeah, I would still probably buy a matched set elsewhere.

If I were you I wouldn't even think "scam". If he hadn't offered to refund your money i may believe it, but he did offer a full refund. I wouldn't opt for the "more expensive" pads as they may actually be of lower quality.
