So...Nissan tech's wreck my car...What to do now?

you baby is hurt!!!!! on a more serious note, i was rear ended before, and all this talk about it not feeling the same is croc! if anything my car feels better!!!! even newer!!! get it fixed by nissan, make sure they pick up all of your debits, including a rental. AND DONT SETTLE FOR A SENTRA!!! you want a nice rental, after all, they f'ed up!

I can't begin to tell you what do do, but the trade-in value will definately go down. I traded in a '03 Mustang for my Z and the GT had been wrecked. I got slammed on trade-in value. I would at least ask for free fix plus loss-in-value money. Hopefully your insurance will not go up because of it. If you file the claim against your insurance, your premium will go up.

this should be treated like any other wreck... Don't let Nissan fix your car. They wrecked your car so who knows if they an actually fix cars. You can take it to a private body shop and have them "fix" it to "OEM" and flip nissan the bill...*hinthintnudgenudge*

second- he needs to check w/ the state laws on deminish of value cause you are third party and you could fight for that, but if you were first party most ins pol wont cover that.
thrid- just because you file a claim doesnt mean your ins will go up there are pending factors like how many claims you have filed on your pol and what ins you have and the BIG ONE- its not your fault.- any good ins co. wont raise your rates on a not at fault AX as they will subrogate to collect on what they paid. therefore my advise (i work for an ins co.) is to have dealer ins. co. take care of your dmgs and collect on deminish of value. but worse case is file through your own ins and have them subrogate the dealer (there is a diff between the dealer and nissan, and it was the dealer that wrecked his car, not nissan) i would also recomend going to another shop you trust and get the tranny checked out as its your right to get your veh fixed where ever you want. also check to see if the dealer ins has prefered shops besides the dealer body shop because most of the time the will give you life time warrenty on those repairs.
good luck man, i think i would have shed a few tears if i were in your shoes. but if you have anymore ? feel free to shoot me a mess i deal with this stuff all the time except in texas so state laws might be a little diff.

i would file a claim and i would ask for a new car because it was not like that when you got it and now your trade in value go''s down unless they want to fix it and take off money because its like you bought a car with and accident history so if you still owe money on the car like 10,000 have them knock it down to like 6-7000. if they dont do that i would fight for a new car.
if you dont want the car anymore anyway (i know I wouldnt) then tell them to buy it off you.

Thos guys went around town showing off and beating on your car, not checking the tranny, and they ****ed up your car. My friend works at a Benz dealership and he does it all the time... he brought an s600 to my house to show me how fast he can go down my street. Those guys don't care for your property, they just beat on it... my $.02 I'm surprised they didn't try to put the blame on you.

Does the Z's onboard computer track redlines? I know that the M3 does and many peopel who blew there engines were denied warranty claims because they had too many "stage 2 redlines" and the computer tracks them. A stage one redline is when you simply dont shift in time and fuel cutoff is reached...stage 2 is when you downshift into the wrong gear and go way above redline. I wonder if you can ask them to see the computer readout to see if there have been any stage 2's. There's no way he could prove that they did that. He can't simply say, oh I've never done that it must have been them. That would never hold up in a legal battle. I'm guessing they're going to fix his car and *maybe* compensate him in some way. But I doubt they will give him a new car. The MOST I can see is them buying the car from him and him having to shell out several grand to buy a brand new car.

I probably won't be able to afford it once the dp for the new car is made...
Since this accident wasn't your fault, what you want is to be made whole again. Whether that is repairing the damage on your car to your specifications (2500 isn't a lot of damage) with a sweet loaner until the work is done or providing you with a sweetheart deal on a 06 Z (a deal like you were the owner's son), they should be willing to do it. If they get pushy threaten to go to the local consumer guy on tv or the newspapers. No dealership wants bad pub. In the meantime you should contact a lawyer for an initial consultation. That way if the dealership bucks on any request you can drop that you have seen a lawyer. Nothing scares a dealer like the "L" word. Good luck
wow some of your guys answr crack me up. the whole point with ins is to put you back to pre-loss condition and giving him a new car would put him in a better sit. thats not going to happen. they might hook you up on a good deal to keep your bus. but they will not give you a new car no matter how much you demand one. like i said they fix your car give you a deminish of value amount and use it for upgrades, and jamnew is right 2500 isnt alot. i dont think you specified where the damages were but if they are up front all that could be is replace the front bumper, impact absorber and poss the reinforcement bar, maybe a headlight and then time for refinish, thats not alot of damage in comparision to what i have wrote for try 17k on an 03 acura mdx or 14k on a 03 clk500, those cars are worth just as much and more than the z is and they had to keep thier car, the thing is you just need to make sure you can have a life time warrenty on the repairs and that way if you trade it in you can explain repairs are under warrenty.
Yeah, they should return it to you looking like brand new and take care of everything cost wise for you. I had the same thing happen to me except it was someone I worked with in a company car and they backed into my car. The company took care of everything.
