Default Warranty woes - I need a co-counsel on this one

anyone have some good points about warranty denial arguments? i know there is the MM Act regarding after market products but this, in my mind, is only a good argument when and if it gets down to an actual lawsuit.

don davis nissan in arlington, tx screwed me over for $730+ so far. the car went in for white smoke (under warranty with 31K miles). they said it was just a "bad MAF" that needed replacing. they said it was not covered and charged me $730+ because some "MAF screen" was missing. Yeah, right. there is now damn screen on these things. the worse of it is that it still smokes now more than it did prior to them messing with it.

officially, the receipt says that the warranty does not cover the problem b/c "it appeared that the ECU wiring was cut into at some point which was the likely cause" for the MAF going bad.

but they did not even fix the REAL problem - the freakin' white smoke.

i've already complained about this to a few awesome members who are helping and advising me but would like more input. i believe, to have a good argument, it is better to get multiple opinions, even though some members here have already provided me GREAT advice.

It sounds like you are getting screwed. First there is no MAF screen when I took out my air box and looked in the throttle body. Second they didn't fix the problem. The most they should charge you is around 75 bucks for a diagnostics which they have no idea of what is wrong with.

I get the white smoke coming from the exhaust even when the car is warmed up. Is this the same issue that you are having? Can it be due to the MAF when installing the Popcharger?

Concerning the “cut” ECU wiring, I had considered paying for a second opinion from another professional shop (not Nissan). But that will not work because an inspection cannot “prove” that the wiring was NOT tampered with. In other words, and inspection will not prove a negative. All that an inspector could state is “We found no tampering with the ECU wiring.” I don't believe that such a statement will get your money back.

i guess my strategy thus far is as follows: the car was towed into their shop after suffering from spewing white smoke from the exhaust, which ultimately led to a "safe mode." the ONLY problem i complained of was white smoke, NOT the safe mode. the only thing the dealer "fixed" was the safe mode (which i do not actually think it has been fixed b/c the car is still spewing out white smoke and will likely enter into safe mode soon again just like last time). the dealer told me that the MAF was bad, not covered under warranty, and that it led to the car running exceptionally rich, which in turn caused all the white smoke (they claim the smoke is really slightly grey). my main complaint is that they "fixed" something that OBVIOUSLY did not cause the white smoke that I originally complained about. thus, i would like them to refund my towing, parts and labor ($730+) and put back in my original MAF (of course they won't have this any more but who cares, that's their problem).

regarding the ECU issue, they did NOT fix the problem with the white smoke. thus, i don't care that the ECU MAY HAVE caused the MAF to go bad (which is most likely just a load of crap). since the care STILL smokes, they obviously did NOT fix any thing.

get a lawyer if you truely haven't done anything to the car that could have voided your warranty, and second go to a different dealer

actually, i am a lawyer. believe it or not though, i too am being taken advantage of. : (

i am currently getting my strategy together. it's good to get opinions from others when constructing arguments, even if they are not based in law.

I had a dealer mess up a repair. When I moved and brought it in to another I paid them and filed a case with NNA. It took some time but nna sent me a check for the money I was out. If you haven't modded your car, did you buy it used? If not the maf should have been covered. Get that car back before you go over 36k and they tell you your warranty ran out.
