Get a Lawyer... NOW. The longer you wait, the harder it is going to be to resolve this issue. You should not have offered to take Nismo parts instead of a new car. This only gives the dealer incentive to try and discredit your case in court, because he will claim that you wrecked the car and tried to extort parts out of the dealer.
By the way, leave the car at the dealer. Dont even think about driving it before this is resolved in court. If you take it home and continue to drive it, the dealer will claim that YOU damaged it yourself. Just drop it off, take LOTS of pictures of the vehicle and damage, and inform the dealer that you want nothing to do with it untill you see them in court.
Dont do anything that will jeopardize your case.

They will get sick of hearing about it before I get sick of talking about it.
At this point in time they feel $1,500 was expensive.
But in time to come, they will wish that they would have paid the $3000.
I seem to have an interesting habit of responding with these things at Quite important events in front of thousands of people when asked these questions. LOL

To answer your thread's title, it happens here in the US all the time as well. It's just that the society here is a lot more litigious than any other I know of, so the mere mention of a lawsuit is usually enough to whip the dealership into shape.
We discussed a case in my grad school ethics class last year where a BMW owner here in the US found out that his car had been extensively repaired and then sold to him as brand new. Dealer claimed ignorance so the guy sued him. What did the Alabama jury award him? $4 million. Their reasoning was that it was to teach BMW NA a lesson they will never forget.
By the way, why not get a Nismo exhaust imported from the US? Will import duties Down Under make it not worth the hassle?

Sorry to hear about the issues tha you are having, if you have some free time you can read what a canadian guy did about getting shafted. I think the dealership ended up pretty much closing down.

Its a lot of hassel. I brought quite a few parts over from the states for my M5, but in the end its not worth it.,
Shipping is a killer and import duty add that to the exchange rate and its not worth it, even IF you get get a decent company to deal with.
I guess I got spolit at BMW, being treated as a HUMAN being.
The V8 ///M3 shouldn't be far off.
I don't think I will own the Z long now. I'm not blaming the Car, I infact enjoy it.
The 450Z will be a hoot, but once bitten twice shy.
I left BMW because I didn't like the New BUNGLE designs.
I loved the look of the Z. But once again, I guess LOOKS aren't everything.

Dont know about Aussie Law, but in the UK you would have the right to reject the car. It isn't as described, so you can reject it. (this applies to new cars, as yours is)

If nothing is in writing to date, I wouldn't worry about any of your prior negotiations. But I definitely wouldn't take a few parts for compensation, you should get a new car. Who knows what the extent of the damage is, or if there is a pound of cocaine still wedged under the dashboard..
Simply tell this guy to replace your car or you will take him to court. If you want to make his life more difficult, contact what every self regulating consumer protection agency you have there (we have something called the Better Business Bureau here). They may be able to have charges brought against the dealer (your situation is illegal here and people get fined/jailed for that).

Bro the answer to this question is simple, wait for that rainy night and let the car go. Make sure to snap an arm or leg and you will own your nissan dealership.
Dealer's are required to make you aware of a car being in an accident however thier is no proof that they didnt do that to begin with. However they are also required to safety check the car, which they must not have just for that reason you are intitled to a 100% refund and a **** ton of money if you are to get into an accident caused by them not safety checking the car.
Either way you will get your money back even if you just call an attorney.

Then leave the negotiations for repairs and extras to absorb the cost and balance the scales only AFTER the dealership has exhausted all efforts to replace your damaged 350Z with an undamaged 350z.

After reading (with intrest) all your posts here, I cant believe that your willing to take 1500 as "compensation". If I were in your shoes, I'd DEMAND a new car. Why would you pay for something "new" and keep it now knowing it was used, and involved in an accident of some sort? Get a few "Fosters" in you, and have a chat with your solicitor, and DEMAND to take whatever action is needed to get you a NEW UN MOSLESTED CAR. This is not Nissan's fault, but the dealership's as you already know.
I wouldnt take that crap, and I dont see why you would either.

I just looked in my beer fridge in the garage, and its got half a carton of Millers and 2 Budweisers in there.
I don't mind Bravara (Brizillian) as well.
I try to get over to the states at least once per year.
The Z is my Golf Buggy. Its fantastic to zip around the coast to different courses. I have always said, Getting there is half the fun. Then when the day is over, I start to smile as the Fun hasn't ended yet, there is still the drive home.
This $tealer is in the wrong and they are trying to tuck this skeleton in the closet. The thing about that is, the skeleton always seems to POP its head out at the Worst possible moment.
A wise man once said, A hero dies but one death, but a coward dies many times. A skeleton can jump out of the closet unlimited times.
These things always seem to come back to bite them in the a$$.
See its not just a $1,500 payoff. They still have to replace the Rear bar. So that's going to need to be painted, to my satisfaction. I used to apply clear coats for a living. I can spot an imperfection in a paint job from 50 yards blind folded.

I had the same issue with my g35...the dealer didnt disclose until I had a lawyer contact infiniti corp...they don't disclose if the damage is under 1000...which is crap because they have the labor cost set at 20 per hour to do repairs! I ended up getting new panels(both fenders and hood) put on my car that didnt have 3 damn coats of paint!

Hell no you were greedy asking for a 3k compensation! And hell YES to the comment you got from the GM. He even knows he's wrong.
I know what it's like dealing with a case like this out of experience. After a while you feel tired of not getting anything decent out of it. Also you question yourself being fair to this ***** and think you might be taking it over the top> which you don't!. After reading all the info you would have been in a really strong position in court against this pathetic dealership.

If you maybe have some paint left from doing your new house or something, I would throw the bucket over some cars at the dealership. Put a note with it saying: This is how the paintjob looked on my car, would you accept this for a 1500 compensation?
(or maybe leave it annomynous if you don't want to get in too much trouble...)
