Would this be tolerated in any other country?
Take one brand new 2006 Z. Crash it. Respray it, and then sell it as Brand new.
Do not disclose it has been damaged or repaired, and Charge Full Price, and give you nothing for your trade.
Is it any wonder why we call them $TEALERS.
I have given them plenty of opportunity to make it right, but to no avail.
They believe that if your rob a bank, if you get caught, you can just say "My Bad" and give the money back and all is well.
The week I picked up my Z it was raining. So the car was dirty and I couldn't see anything.
So When the rain stopped, I washed the car and prepared to detail it.
Whilst detailing it, I noticed on the back rear bar, about 50 Pin holes, like air bubbles had popped. The more I looked the more I found, an entire nest of them.
My heart skipped a beat because I apply clear coats, and I am immediately thinking, This bar has been resprayed. And poorly.
As I wipe over it, I notice the bar is really flimsy. Extra flimsy.
So I give it a little poke and think, this can't be right.
I crawl under the car, and notice the drivers side bracket is extra loose and flopping around. I look to the left where all the pin holes are, and WTF. NO Bracket. It has completely been snapped off.
I can see the rough plastic where it USED to be. I cn see the Naked post hanging down that the Bracket is meant to be attached to, but No Bracket, Its GONE!
MF $tealers have sold me a car that has been in an accident and has been repaired, and they did not disclose that to me.
So I make the call. My $tealer plays dumb and says bring it in we will take a look at it.
He sees the pin holes, and the bracket gone, and calls a tech out. The tech crawls under as the GM says, We can fix that?
The techs blood drained from his face and said NO that can't be fixed, he will need a Whole new Rear Bar.
The GM said, No problem we will get you a new bar. When would you like to bring it in, next week?
I said Hold your horses. You have just been caught robbing a bank, you don't just say I'll give the money back.
I said I want either a New Car or I want to be compensated for the deception and the fact I paid for a NEW Undamaged car and got a repaired one.
I said I want a Nismo Exhaust system as compensation and then I would let them repair it as appossed to giving me a NEW undamged vehicle Like I paid for.
He said he didn't know the cost of the Nismo exhaust and would get back to me. I said I saw them on THIS board for $900 USD.
He gets back and says the Nismo Exhaust system is $8,000 AUD and that is not going to happen.....WHATEVER !
They said they could do a copy one for $2K and they would go halves in it. LIKE BLOODY HELL!
I said O.K. what about Nismo S-Tune Suspension. They ring back yesterday and said it is around $2K but after fitting it would be closer to $3K AUD.
He then said that is not going to happen.
I said, No problem, then just give me what I paid for, A NEW CAR- Undamaged.
He said, That's not going to happen. I said well then instead of dealing with me, you can deal with my solicitor.
He said O.K.
WTF. Can you believe the arrogance of these guys?
On what other planet have they not totally disgraced themself and the name of NISSAN.
The solicitor told me to contact Nissan Australia and exhaust all possibilities before he took my deposition.
I called them. All they did was call the dealer and let him no I called them.
The dealer called me and said arrogantly, Iknow you called Nissan Australia and I DON'T CARE. It wont make me move any faster or do anything differently.
I called back Nissan Australia, and they said, Its not their problem.
They said if the car had been damaged prior to the dealer, its their problem, but because the car has been damaged at the Dealer, its the Dealers responsibility, and they do not own the dealer.
Nissan Australia said its between me and the dealer.
I said, so Nissan Australia are happy for their $tealerships to commit breeches of the trade Practices act, and you don't care?
They said its between me and the dealer.
I would really like this to get back to Japan. I'm sure the Head of Nissan expects dealers to act with Honour.
This sought of crap should never happen in NEW CARS. This why NEW car dealers like to distance themself from used car $Tealers. But this proves they are tarred with the same brush.
I think I was being very reasonable asking for a NISMO part as compensation. But it seems that the dealer would rather be breached under the trade practices act.
If they have to supply me with a new vehicle, it is going to cost at least $10K - $15K. The loos in GST alone would be way more than the $3K exhaust.
They oblviously have ZERO regard for customers.
Nissan Australia added that the dealer offered $1K to $1500.
The CRIMINAL doesn't get to set the terms of his sentence.

you should be entitled to a full refund for what you paid... Basically the contract is undone and the parties are returned to the postition they were in before the contract.

1. From the start you should have asked them to replace the vehicle or reimburse you the difference. You paid for a new, undamaged Nissan 350Z - that is what you should have asked for to start with.
2. When you opened your negotiations with the dealership with getting (any) Nismo parts as 'compensation' in addition to fixing the original problem, you set the dealership up into a defensive posture. They're not going to be willing to work with resolving the original problem: The damaged "NEW" car in your possession.
In other words, asking for the Nismo stuff was not pertinent to repairing the car nor replacing the car with an undamaged one.

My advise at this point: Contact your lawyer and possibly take the dealership to court.
The car had 89 km's (50 miles ?) on it. Most New cars have a few km's on them.
I now know why it had so high km's. It was the drive back and forwards to the panel shop to respray the rear bar.

Because of the HUGE cost involved of doing that, I thought they would be flexible to negotiating a WIN/WIN deal.
They Win by not getting stick with now a car that IS Second hand, and not loosing all the GST. And I Win by getting some NISMO mods.
They win becuase $3K in suspension has to be Loads cheaper for them.
They tried to pull a Fast one, and they got caught. They should be happy that I was willing to accept $3K in compensation for something that should be costing them a load more.
If they had of just giving me the suspension, I would not have even told anyone. There reputation would have remained in tact.
Anyone responding to this thread, I would like your OPINION on weather you feel $3K in S-Tune suspension is Too much compensation.
Do you feel I am being greedy? The GM said to me, I KNOW you will try and MILK this for everything its worth.
That annoyed the hell out of me. I came up with a workable soloution. They don't want to take any responsiblity.
I never even asked for an appology, nor was one offered.

You are correct in saying that Compensation is designed to put the parties back in the original position prior to the contract.
However that cannot happen now.
I traded a Business van with full sign writting.
They have not only de-sign written the van, it has been on sold and gone to a transport company.
So it cannot be put back the way it was.
It goes to show the calibre of people we are dealing with. $3K and we all get on with our lives.

If you can't resolve the matter with that Nissan dealer take them to court. You just have to know when you can't talk to someone anymore and get things corrected, you have to go higher up. If that doesn't work go higher up than that. If that doesn't work call the Better Business Bureau and a lawyer.

This is complete B.S...do you think he doesn't know this? When you walked away he was prob. thinkin' what a f'n sucker. He "offered" to have you pay $1500 for "half" of the Nismo exhaust!? That's B.S....that IS the cost of the Nismo exhaust. This guy is a crook and they only understand one language. You have to speak to him like your on the level. You should have gone in there outraged instead of sounding like a push over.

MIB this is a NEW car? How did it get into an accident with almost 0 miles? Or was this a used car thats pretty much in new condition.
Because if you bought a NEW car then they def broke some law by selling you one that isnt brand spanking new. Here in the USA there is a law that the dealer has to tell you if the car was in an accident that cost more than 1k to fix (i think thats the ammount)

NO PREVIOUS OWNER. Straight from NISSAN to the $tealer to me. I am the First owner. It is not a demonstraighter it is BRAND NEW. FULL price Brand new.
The $tealer that had the car at the Gold coast Stealership was moving the car and either backed into something or backed into it with another car. My $tealer never had a Silver car, so they took this one from the Gold Coast stock.

They Should have disclosed the fact that the vehicle had been damaged. It had not been previously owned, It was Brand NEW and sold to me as SUCH.
I was the first person to have it registered. ITS NEW.
So they have said they will replace the Bar with a Brand new one and make it Brand new.
They will also give me $1,500 , That's it.
I am so pi$$ed off at even dealing with them, I am going to take the deal.
But I said, NO GAG Order. I said if you want me to shut up anout this, I want the Suspension.
For $1,500 you have fully Shafted me, and I will tell the entire world and everyone who enquiries about it.

Granted the damage is minor, those brackets are flimsy. One has snapped off, and they have resprayed the left corner of the bar. There are no scratches on the exhaust or anything. So it would have been a $100 Bump, either another new car into it, ir it into something.
The point is NO DISCLOSURE. Do you think I would have accepted a $1,500 discount on the car had they of disclosed this? No way, I was buying NEW and I wanted NEW. Maybe I would have accepted $5K off. But in the end, I get forced to take $1,500. The legal system here sux and is in the dark ages compared to the states. (Sometimes thats a good thing).
They'd best not EVER send me a satisfaction form. I will take 5 days to type everything in it.

I see it in the states for $900 USD. But there are no compenetent people in Australia when it comes to Nismo parts.
I have tried 8 places. They either make up a number so stupidly high that you will forget about it, or they just never call you back. (One dealer siad $8000 full and the other said $5000 for just the can, kiss my johnson.)
No one is interested in selling NISMO in Australia.
I may spend the $1,500 on all the 4 GT Spec braces.
Then find a Suspension place here in OZ that will do some customized coilovers and Nissan and NISMO can kiss my hairy butt.
