Destruction of customer records -- the "shredding" law
Businesses are required to take reasonable steps to destroy records containing personal information upon disposal of the records by shredding, erasing, or modifying the information to make it unreasonable. California Civil Code §§ 1798.80-82
No, The Professional is only semi-correct.

You read the law incorrectly, that law deals with the DISPOSAL of information. IE a California business cannot simply trash electronic credit card reciepts, they have to shread them thus dubbed the "Shredding Law."

Trust me, I have been doing credit card sales for many, many, many years.

There is nothing incorrect about the way Perf. Nissan has handled this issue. Infact, they have followed the issue by the book because it is required by California State Law to report to your customers when your database has been breached.

You sound like you have some interest in playing this down for Performance Nissan, are you a vendor for them?

I don't think that we should go to this length...things happen. In this new found interlinked world, stuff like this happens all the time. A mistake was made, eh, sobeit. Eat the card and get a new one. It certainly won't change where I get my parts..you just can't beat the deal.

Just got the lettter about 2 days ago also......sucks but hey...thats life. Had to cancel the card and get a waiting for a new one. Better be safe than sorry. As far as ordering from performance nissan goes.....regardless of your position ...you have to respect them as a company for informing us about this and protecting us as their customers. I definatley will be ordering from performance again....they just have incredible service and quality thats unmatched by the competition. Good luck guys...

On a side note...here is an idea for everone to think about. I think Performance nissan should give us some kind of compensation ( online credit etc ) for us having to go through all this. What does everyone else think?

+1 Haha.

Luckily the credit card I used to order stuff off of their site with was one that I keep just to order little things off the internet and it has a $250 limit just because I don't trust internet transactions. I've already nearly maxed it out for the month

Got my letter a couple of days ago as well. Cancelled my CC & I should get a new one in a few days. This stuff happens all the time so I'm not surprised at all. I'm just glad they sent out a letter letting us know ASAP so we can do some preventive measures instead of sitting on their *** & hope that nobody finds out about it. I always had a great exprience with Performance Nissan so I do plan to continue to purchase from them.

Got my 3 letters today - used 3 different cards over the past two years. After 3 calls, got the account numbers changed and new cards to arrive in 5-10 days. I've ordered lots 'o stuff over the past 2+ years....nothing in the past month or two, but didn't want to take any chances. No suspicious charges, no charge to change accounts, no biggie........

The guys at Performance will ALWAYS have my business!!

Just got 2 letters today. One of the cards was replaced some time ago. I had to get another card per second letter. O well. Looks like I am calling in my orders from now on.

Got my letter today. (Un)luckily that card was cancelled already because someone already used it by over $2000 in tickets to Spain on Iberia Airlines sometime last year.

Ouch! But, it sounds like you caught it in time and disputed it right?
