Nissan Service Dept. $UCKS!
Angelico what dealer did you bring it to and where in CT are you?? I have to bring my car in on thursday for a few things. I bring it where I bought it, George Harte Nissan in West Haven. The sales dept. absolutely sucked when I bought the car, actually they only sucked the day I went to pick up the car. The service dept. however has always been very friendly and helpful. I had to have my transmission replaced on my 05 and they did it without hesitation in only a few days time. I'll let you know how they are after this visit maybe you could give them a shot.

no the dealer doesnt. the customer does. they also sign a waiver stating the dealership isnt responsible for anything that happens to the car while its there.

Uh, no. That doesn't sound right. So if they crash your car pulling it out of their garage they are "cleared" of any responsibilities? I don't think so. They are responsible for your car while they are in possession of it. A parking garage is a different example. They are just renting you the space so they are not responsible if someone breaks in. But you're talking about giving someone that's going to work on your property, so of course they have to be responsible for it. If you bring your TV in to get the power supply fixed and the guy shatters the glass screen is he responsible for it? "Oh yeah, I changed out them thar power supply but somehow the glass is gone, oh well, I ain't doin' nuthin for you there! Pay me and take it away!"
Maybe you're talking about them not being responsible for items within the car that get stolen (which everyone should know to take with them before leaving the car)?
Never dealt with the BBB but I don't think it needs to go that far. I think you need to meet with the manager/owner of the dealership and sit down and explain the situation, and calmly request an explanation other than "Not sure what happened".

i think i know what i meant. look at my avitar, i am a dealer. look at your ro's (repair order reciepts) and you will se a disclaimer between 2 and 3 paragraphs long stating the dealership isnt legally responsible for anything that happens while the car is stored at the dealership (anytime before or after work is completed it is being stored). a dealer may honor something to make things rite with the customer. but they are by no means resposible to.
300 miles from my place would be like going to vegas. i would be bugging the ish outta nissan if i found out they drove 300+ miles with my car. not because of the mileage but just thinking about someone taking my car out for a joyride w/o my permission would aggravate me. you don't know how hard/aggressive that person/mechanic was driving your car. for all you know, he could have been banging against the rev limiter every now and then or wearing out your clutch. i'm about to take my car to the body shop after an accident and now i'm gonna be extremely careful about my mileage. keep us updated
i think he meant that the dealership will do what they can to get out of it- you've already agreed to their terms. many dealerships, if you harass high enough, might be kind enough to do what it takes to keep your businesses. this one may not. of course, you can file a small claims case against them but odds arent that good in your favor...then again who knows.
as far as their disclaimer goes, you cannot sign away gross negligence. so in your example if they did something that was obviously wrong, and something happened to your car as a result, you'd probably win the case (in court). however, i dont think this is a case of gross negligence.
if it were me, id knock on all the doors i needed to about it. if you got to the top, and no one wanted to make it right, and you were still angry, then you have one of two options: 1. do what you can to hurt their business by advertising your situation and 2. take them to small claims court. only you can assess whether or not its worth it. if it were me i'd go through the company, then take option 1 above. if i really hated them i might do option 2 as well, but court costs a lot of time and money.
at the end of the day though john is right and you'll need to take your businesses elsewhere.

but in the end there is nothing you can do except to file a complaint with the bbb and hope people will go in and see the complaints against the store and not use them.

yea, exactly. if something happens during storage nothing can be done (before and after work is performed) if something happens while the ticket is actually being worked on then you have a leg to stand on. (only way you would hold the dealer liable is if you proved the mechanic/advisor were out in it racking up the miles during bussines hours.) and you will never be able to prove that.
make a complaint and maybe the gm will give you a couple of free oil changes or something. but, do you really want to take your car back to have work done again when you got your mechanics *** chewed? i wouldnt.

Unbelievable....My car only has 12,000 miles on it and through circumstances dealing with my local dealership's service department, I decided not to give them another dollar of my money. Accurate record keeping and the repair shop of my choice from here on out.
BBB does work, but I don't know about dealing with car dealership. I got $400 back from T-Mobile after my mom's phone was stolen, and used. And I never got my T-Mobile rebate in over 10 months even though I sent with certified US Mail receipt. Be careful with stolen phone, I found out that the user is responsible for charges. I did BBB by e-mailing them. Anyway, I haven't been to a dealer in a long time since my car just get oil and filter changes in my garage and the car is a 2nd car. I know Toyota has mileage IN/mileage OUT. If your car was used for 300 miles, I would not just let it go. 300 miles, not only depreciates your car, but the wear and tear. Do you think that the un-authorized driver will drive easy, NO!!! Don't let it go!!
Well a few things, one I do have proof. On my service report it shows miles in and miles out. Its about 340miles difference. They had my car for 7 days and its all on paper.

I am imagining a scene like in Ferris Bueller's Day Off where the guys working at the parking garage take the Ferrari out. The guy who owns the dealership is wrong, you can do something about it. Ask for reasonable compensation, and if you don't get it, file in small claims court. Perhaps you should have the car checked out by a mechanic as much as possible as they might have worn out your clutch our transmission. Good luck.
