Windshield cracked by gravel truck

Default Windshield cracked by gravel truck

I was driving on the freeway, and my windshield was cracked by a rock from a gravel truck. The crack isnt big, more like a ball point pen on the impact point, but underneith it, there is a crack like, inside the glass maybe "----" long. I called highway patrol and they said I had to go in to file a claim, but they were already closed, and closed for 4th of july, so I have to go in on wednesday. I got all of the trucks info, license plate, truck number and company. I asked highway patrol if I should call the company, they said they would do that after I filed the claim. What do you guys think my chances of getting the company to get me a new windshield is?? I dont want it repaired, I will still see the hair line crack in the window. I called a mobile window repair, $45 to repair, $205 for new windshield.

Any thoughts?

I doubt you'll get the company to pay for it. Most trucks have "not responsible for broken glass" on them because this happens a lot to other drivers. I have 2 chips/hair cracks in mine (my buddy's porsche threw one right into my windshield. When we were racing. ) I bought a glass fixer at walmart for 10 bucks and sealed them myself. I'll just live with them until I get an actual crack then replace the windshield.

think the highway patrol officers are the expert on this, and they would tell you not to waste your time if that was the case.

Call your insurance company. Your comprehensive should cover it 100%

Most insurance companies will pay for crack/chip once a year. We have USAA and have used that service twice in 3 yrs. +1 On the not responsible signs on the gravel trucks. GL

They are responsible, but you have to prove that the rock came from their truck. They could put any sticker on there they wanted to, but in the end, they are responsible for transporting their load without having it end up all over the highway. That is why you see tarps over the tops of them, just in case. For a rediculously overboard example, you could be transporting a ladder and it flies off and hits the car behind you or they run over it. You are responsible for any damage caused, even though you had it tied down. Until it leaves your vehicle at the intended destination, you are liable.

I may as well walk into a restuarant with a machete and start hackign away at people while wearing a sign saying 'not responsible if you get in he way of my blade'

Yeah, I think I'll put a sticker on my F-250 that says "Not responsible for running your a$$ over", then no one can sue me for it. My insurance(Progressive) covers it with comprehensive but I have a $500 deductible so theirs no point in making a claim for me.

My insurance fixes rock chips for free. Too bad I didn't know that when I got a chip after having my car for about 2 months. I had it fixed directly after it happened. I stopped off at the glass shop that's right on my way home from work and the guy had it fixed in no time. $20

I would call a lawyer, and possibly even contact your local state representatives. Make a federal case out of it. Take it to the supreme court if you have to. Rock flingers should be prosecuted to the fullest extent of the law.

Once again, check with your insurer. There should be zero deductible on the comprehensive portion of your coverage.
I have never had to pay the deductible for windsheild repair. I have 5 replaced over the years, with 3 different insurance companies.
