Hello, Nissan? LAWSUIT TIME!
Take it to a independent foreign car repair shop. Preferably one that specializes in Nissan repair. The independents love to stick it to the dealer service shops. They know word of mouth gets around. Good luck, keep us updated.

A lawyer will not take your case if there's not a good chance that you will win... Chances that you willl win increase if you were to have actually got hurt(sad to say but it's true) and it was an issue where Nissan was aware and tried to hide or dismiss the problem.. In other words, intentional neglect...
If a lawyer were to take your case, it would most likey be on an hourly basis and we all know what those robbers charge.
In the end, if it even does go anywhere, it will be a fight between you and Nissan the corporation.. Who do you think has the deeper pockets and best lawyers?

I am sure one would be willing to take on Nissan if you could reproduce the problem and have it documented by a few qualified and respected shops.
If Nissan see's that this problem is legitimate they will double back and pay you off. It would be detrimental to there reputation in canada if this even hinted to a possibility of affecting any or all 350z models.

I've had enough. I'm taking these ba$tards to court. They're gonna pay for this. The 5th gear lockup CAN BE REPRODUCED and I'm gonna have the car inspected by a few places tomorrow and have reports written up. I'm gonna bury these bastards.
Any advice?

Good luck buddy! You won't be able to find a contingent lawyer anywhere that will take this case. Your only chance would be to hire a lawyer on a hourly or flat fee rate. Since you are so up in arms about this I think they best they will do is repair your transmission and send you on your way. Nothing happened except you had a repair done to your car and something wasn't reassembled properly. If you had been in a colission because of this then it would be a different story.
I'm sorry but your story about changing lanes and almost getting hit wouldn't fly for 10 seconds. If you had sufficient space to change lanes a car wouldn't have almost hit you because you began to slow down. Most drivers would have slowed down to avoid an accident and not rear end you because you were going a little too slow after the lane change.
All that would happen in this lawsuit is you would waste your time and money. This would be thrown out before it ever made it to trial. You would probably be so arrogant to not accept Nissan to repair your transmission and you would go to trial and a judge would laugh at you and you would get nothing.

Why did you shift up if the car in the lane you were moving to was closing on you as fast as you said? To the point where it traumatized you and make you think like you were going to get killed? And if your tranny "locked up" you definitely would't be in neutral and just without acceleration.
If the car was coming up that fast wouldn't you downshift and accelerate?
Sorry, just sounds like your being a little bit dramatic.
You really don't have a case. Sorry.
But I am curious about the mileages these incidents occured at? Maybe some of us can get some type of useful info out of this.

Sounds to me like he was racing down the highway right after he got a new tranny put in and something wasn't done properly. Go in and tell Nissan that you went highway racing as soon as you pulled out of the dealership and your car malfunctioned. Don't raise too much crap about it and maybe they will fix the malfunction and wash your car for you. Raise hell and they'll say it is out of warranty and you are screwed.
