Default victimized by another car

so here i am just cruising along. picked up my younger brother from school. a tan ford explorer is passing by in the lane (left) next to me. somehow they ran over a good 4 sq inch size concrete block with their back tire it flings up in the air and flys right into my front side bumper and nicks off paint all the way down to the plastic. and you know how when something hits plastic it digs in and curls the plastic yeah imagine that. i tell ya right then and their i knew from the loud noise that something wasnt right. when i got home i was like mother freaker!!!!!!!!!!!!!!!!!!!!!!!!!! i am so pissed. has anything like this happened to others? id love to hear.

did you get their plate? I'm assuming not. The same exact thing happened to me except I chased them down and killed the bastards. I tell ya, you gotta take the law into your own hands.

Are cars liable for the road debris that they kick up?

Here in Florida, only if the object comes off the vehicle itself is that vehicle liable. All "road debris" is your responsibility to avoid. It depends on the OP’s state law in his case.

yes i did get their plate number just incase. i wasnt sure though if for the state of wisconsin i could get them to pay for the damage from road debris. it sounds more reasonable to get them for something that would of came off their car. but just incase i did get the plate.

I think you're out of luck in this case, if it fell from their vehicle then you'd be good, but i dont think it would hold true for the road debris

Why not call your local PD to find out what the law says? I highly doubt it will favor you though. In most cases, unless the item fell from the car itself or you can prove that driver deliberately drove over it to harm your car (practically impossible) you are SOL as road debris is generally considered a hazard every driver agrees to deal with when getting on the road . I am getting some scratches fixed myself when the car returns from storage; these were left by a gigantic flattened cardboard box that flung onto my hood on the highway doing 70.

can you really get the state to pay you for road debris?

wouldn't the state just relate it with the same situation as getting a flat tire?

thus deeming it pointless for you to go after the state or the other driver

atleast it didnt happen like mines last week picking up my little brotehr from skool, where a red explorer did not see me parked with my hazards on and just ramed into the left quarter panel with its stupid side step bar... how the f*&% do u hit a parked flashing car?? stupid b**ch asked me if i was ok... no im not ok u just rammed my car!!
