Sorry to hear about this, im glad your alright. I got rearend in my ppw and the cost was 7200, i lucked out, they were able to save my quarter panel and all the tail lights. Should have called the police. Couple rules, First make sure everyone is ok, second dont take to the other parties about whos at fault tell after the police arrive and/or talk to your ins. agent. Also take pictures of the accedent right then and there if possible. (keep a camera handy)
Good luck if they fix it. And match sure that the ppw matchs, i mean step back, get your face on it. If it doent look right to you before you pick it up, make them redo it. Ill have to have mine redone as it does not match. They will also do a fade of the paint to blend it in, make sure they do it to all sides.

In general getting a police report is a good idea, the fact that you have two witnesses, you should be fine. Regardless of you jamming your brakes, it is not your fault. Insurance company will investigate the damage on the other car and yours, and it is obvious his front is damaged and your rear end is damaged. It will be next to impossible for the other person to blame you. The only thing you should have done, was take pictures of the accident right after it happend, but I don't think you will have any issues with the claim.
The damage looks like there will be more than just the body panels, pick a good repair shop, and don't just take whatever the insurance company recomends if they don't seem like good shops.

yeah if have frame damage better hope its a total!! The damage seems to go all the way to the hatch thats not good!! Make sure for certain that if its not totaled that they run a full appraisal of the damage, or you'll be in for headache!!!

after reading this thread many of you mentioned getting a police report. When i got rear-ended a couple weeks ago the first thing i did was call the cops, but the dispatcher said cops will only come out if..
1.)the vehicles are obstructing traffic and
2.)serious injuries/fatal etc..
the dispatcher just told me to call my insurance.

You need new quarter panels, taillights, hatch, and a rear bumper assembly, you could have some rear body panel damage and maybe a trunk floor, but I can not tell from the photos. They will have to blend both the doors which means that all components have to be removed and installed. Depending on the parts available in your area, your looking at probablly $6000-8000. If there is undercarriage damage you'll go up even more.

Ouch that sucks. looks like a lot of damage. Get rid of it. Tell the insurance co. that the frame might be damaged. tell them u felt ur seat move a little. Looks like u will be about $12k-$15k in repairs, including parts n labor.

The lawyer will refer you to the write doctors that specialize in whiplash and neck injurys.

BTW- They will come out if one of the parties do not have insurance. That's what happened to me. My insurance company had to pick up all the costs because the other guy didn't have insurance and was already being tapped by his X-wife beyond the ability to pay. Thank God I had uninsured motorist or I would have been out about 10 grand. You only get your ded back if they collect from the uninsured .... Doh !!! So, I was still out $500 .... and that sucked cause I don't really have that type of money laying around to toss to the wind.
