Get your money back. Look for a private party, one owner car with a carfax report. Spend a 100 dollars and have the dealer check it out. I used this formula several times, and it worked for me.

I wouldn't have a problem with a new motor. But I would certainly insist on a free rental so that I have some transportation.

I'd just get my money back. Why hassle with it? If you didn't sign a waiver for the 3 day return and returned the car in 3 days... or let them know to pick it up.... your OK. However, if you have agreed to have them look at the car or fix it.... your committed to that. Good luck. I've had motors replaced before ... no issues.... then again...

If he is pulling a fraud with the extended warantee company ... Have no part of it. Your just asking for trouble there. Tell him you'll report him if he does and get your money back !!!

Dealer does not want to give me my money back, Got paperwork from court, taking him to small claims court for my down payments, tows.

Here in TX there are lemon laws, applied to new of course and I think used cars as well. Doesn't sound like that dealer will have much ground to stand on in court. I would bet he would refund your money before actually going to court.

shouldnt have bought it. i feel bad but u really need to learn how to buy a used car and not just run out and get the cheapest one u can find. sorry.

Update: Won The Lawsuit, Judge Has Signed Off On The Judgement So If They Dont Pay. They Will Get Garnished Sooner Or Later.

Honestly, I would of kept it. The grinding is the synchros. In the 03 models they were jacked up. So all you had to do was take it into a Nissan dealer and say "My 03 tranny is grinding, give me another." and you would have the updated tranny. You could have them do that while the new engine was being put in. Then you have a new trans and engine in a car you got for less than a new one. But, that's just me. idk, prolly not the best choice though.

Man that sucks,I would have lost it.Thats why I bought a 2006.5 base brand new a year and a half ago for 23.000 over fully loaded used ones.That were around the same price.

I thought earlier that he said it still had some warranty. Either way, that sucks for the people that their to act up after the warranty is gone.

Depending on money and investments, my next car will be either a 2005/2006 350Z, or a 2005 C6 Corvette. Mustang Project is finishing in 3 weeks, and BMW X5 doesnt come off lease till end of october.
