If you decide that you don’t really mind the spoiler, I would consider getting the car (its an awesome ride). However, I would not give them a penny for that aero package. The only way that I would pay for an accessory I did not want would be to get something in return such as extended warranty. That’s the good and bad thing about dealerships-you can always negotiate. I would not compromise beyond that.

WOW THANKS FOR THE ADVICE EVERYONE!!! I am going to call them up and tell them that I do not want the aero package. Its a great deal but they already said they would absolutely not negotiate the $500 add on, so I will tell them give me my $1,000 and I will wait for a time and place where I can get the car I ordered. I did not spend my time and money to get a car I don't want, I want the car the way I ordered it. If they were able to come down to about $250 on the add on I would probably get it.

Mud guards do not come on every car. Nor do they come with floor and trunk mats unless you order them. This dealer sure sounds like they are giving you the runaround.

Yeah.... they are giving you a big one where the sun doesn't shine. Even if you do take the car, I would call NNA and tell them the dealer is flat out lying to the customers. That is completely unprofessional!
WHats a good way to ask for the VIN number without looking suspicious to the dealer, I want to see if these guys are telling me the truth. If I find out that they are lying to me I am going to ask for a bigger discount on the car. Any ideas on how to get the number? Thanks!
In NJ you need a VIN number before you can get any quotes for car insurance. Tell them you are shopping around for car insurance.
If you are not shopping around for car insurance you will still need a vin number to add the car to your insurance policy and/or see how much they will charge you.
On a side note: if the dealership ordered a car for you from the factory I believe you should already have a vin number ?

btw. regarding your previous post-i have a track and it came without splashguards. Since I wanted them on my car, the dealership ordered them and i got them installed after about a week.

They wanna play hardball? Fine. Yes, they are lying, the aero kit could easily be used on the 2004 model, there is no difference.
To play hardball, you gotta be able to walk away from a deal you don't want...or at least bluff real well. Wait until the car gets there and go down to the dealership. Tell them you really don't want the aero kit on there and you won't pay for it. Say "I am ready to make the deal...but without the aero kit added in". They will possibly remove it, the might even just throw it in. They might balk also, if it was me...I would turn and walk out. They WON'T want you to leave. If they don't give you the deal you want...there is a real good chance they will call you in a day and tell you to come on down they can do the deal. The aero kit line is BS and dealers have a better profit margin on the add-ons than they do on the car itself!

Didn't you fill in a purchase order when you gave them a deposit on the order? I had a semi-similar problem where the dealer I originally went to kept trying to sell me automatic trans, different colors, or other models (always more expensive, of course), not on the PO. Finally I told the guy what lewd actions he could perform on himself and got my deposit back. As it turns out, I ended up flying to Ohio from CT and driving the car I wanted back. A bit of a pain, but when you know what you want and no one else can get it for you, you do what you gotta do. Not to mention is nice to exhaust the break-in period on the first trip...
Anyway, assuming you have a purchase order that does not include the aero kit, point to it, say 'this is what I ordered, this is not what you're giving me, fix it or I don't buy at all'. Legally, they have no legs to stand on.
Now if you don't have a PO, or you didn't list what options you wanted, you could be screwed. If the dealer wants to be hardassed about it, they can say fine, don't buy the car, but we're keeping your deposit. Unless you have something documented and signed saying "I want X" you could be in trouble.
Also.. how hard is it to take the aero kit OFF? I was under the impression that the side airbags were the only factory installed/permanent option. There are probably a couple holes in the hatch for the spoiler, and I'm not sure how the chin deflector is attached. Is it something they could just take off the car? If you really mind the holes, you could try to get them to replace the affected body panels, but for all I know you might be putting on an aftermarket front end or spoiler yourself and not care about holes anyway.
One thing I learned, is that the stereotype that many if not most dealers are simply out to screw you for commission seems to be true. I had 3 different dealers tell me that there will be no coupe in 2004, only the roadster. This doesn't bother me too much since there don't seem to be any significant changes, but it's still shady.
Also, you can always try calling Nissan HQ and complaining. It's somewhat unfortunate, but you'd be surprised what you can get with liberally applied complaining.

Oh trust me I will definitely let you guys know how everything goes, I am willing to walk out from the deal. Also if things do not work out, how long would it take for me to get my $1,000 deposit back? Since the car did not come in the way we agreed I should get it back and I am afraid that they are going to take their sweet old time getting my money back. Have you guys experienced this? Thanks!
Also for a new 2003 Touring 5AT for $31,600 (with aero package and everything except navi) w/o tax is that a good deal? I will let you guys know what happens, more worried about the $1000 I put for a deposit if things go south with the dealer, do you guys know how to get the money back if deal falls through? Thanks
I am pretty sure most states have a law that says the deposits must be refundable (you'd have to check that).
I agree with Mayvik - Look over that piece of paper that they gave you because it should have everything listed on it. If they can't provide you with the car that you ordered, I don't see how they can keep your deposit.

The options you mentioned are not automatically on all cars. They are options. You choose them if you want them and you pay extra if you do so. They are lying to you to make more money, plain and simple. If at all possible you should find another dealer.
