I hope it was no ones fault for a BJ =p

But seriously, whoever started backing up 2nd (I assume you were both back up simultaneously) is at fault. In my younger years A mini-van and I backed up simultaneously and I owned the **** ***** out of her bumper (I was driving a cougar at the time and it didn't do anything to my car). We didn't end up going through an insurance company either, but in that scenario it's pretty much whoever starts backing up 2nd that's "at fault."

Honestly your door is pretty screwed, it may have been worth it to file a report because you're going to have to go through insurance either way and you might as well take that broad down with you...Depending on who saw it, and what happened she might have had to pay.

my question is...

if your backing up and your out, then you see an X5 coming toward your driver door (i'll assume you can see the car through the window) what did you do next? Take the hit, or hit the horn like a maniac? I've had some instants where a parking lot driver came close here and there, but my trusty HORN and loud Yelps pay off in the end. Get yourself an AIR HORN for that Extra persuasion!

Insurance company called me and basically told me it was my fault but still under investigation. The insurance company couldnt make sense of our conflicting stories. There trying to tell me that shes saying my car was so low and its not like that from the factory that she didnt see me. Although I had a car in front of me and could not move.... Its a crock of **** if u ask me.

Im not worried so much even if is my fault, im 30 with a perfect driving record with zero accidents, ones not going to kill me. I would like to get my front fender painted anyway from bug damage.

So what do u guys think I should do about the damage? I have a 1,000 deduc and the insurance company wants me to go get a damage adjustment and give me a check, or should I goto a body shop and get an estimate?

Thanks guys for all you help in this really shitty situation.

^
so you were pinned in a parking lot and some dumb chic starts backing up and yells that your car is too low so its not her fault she hit you?

if you let that stand and you stay at fault......ur an idiot...

it sounds to me from your mod list you have a really nice car...i wouldnt just sit back and take it.....better get both you and her story straight...and get the insurance company to wise up to it being her fault...

since when is anyone backing into anyone in a parking lot your fault...your car is too low my azz..

Yea I dont think the low car thing is going to fly but thats whats shes saying, I was in motion was the problem. It going to be my fault in the end because I cant get my story straight becasue it happend so fast I really dont know what the hell was going on. I dont know if youve ever been in a situation like that but it sucks becasue you dont know what to say. Its basically going to be on my own because her car had slight scratches on the bumper and when I talked to her she really didnt care about the damage but she wanted to have it looked at still.

Im really dont care how it goes I just want my car fixed perfect and dont know how to handle the situation as far as where to go and what to do insurance wise. Go get a check minus the 1,000 deduc or goto a body shop.??>??

Have the work done by a professional of course. Not sure if Florida law requires you to run around collecting estimates.

$1000 deductible isn't insurance. The price for a $500 deductible for me was an additional $10.

Shoulda got a much better deductable.

In further addition, especially on a car like the 350z. You know practically any damage is going to be more then $500, so why not just get a 500 deductable..

Guy sure seems calm when his z was beat to ****. And doesn't even care if the insurance tells him its his fault (when really it isn't when someone reverses into you while you are at a stop). I'm sure you'll care once you see your next insurance bill (when it goes up). You shouldn't even be having your insurance involved let alone worrying about your deductible. You should over look your insurance when you have a 1,000$ deductible. B1tch in the X5 must of gave up some fine pootang for you to let it slide like that. Should of gotten her insurance, pictures, police report.

$1000 deductible is ****. i would go around different body shops and take the highest quote to the insurance company. and the low car excuse wont stick if your ride height is street legal.
