one time in my 68 camaro I had to make a similar judgement call. a minivan cut me off and slammed on their brakes, they had kids in the back, and I was 10 over the speed limit. I could A: rear end them with my tank of a car, B: swerve in to on coming traffic and slaughter whoever I hit, or C: swerve on to the sidewalk on my right and slam on my brakes.
I chose option C, it seemed the most logical. I took out a bus stop sign flat to the ground and just bent the front header panel, bumper, grill etc.
we were both ruled at fault, had i just rear ended the ****er it would have been his fault.
lesson learned.. just hit them, they were at fault, and you won't be dinged.. :/ in my case I would have felt like a total dick though, I'd fear for the lil kids life
