Got Rear ended this Morning !!!

Default Got Rear ended this Morning !!!

Boy am I pissed! I was stopped at a stoplight right in front of PacBell Park and all the traffic besides me are stopped too. Then all of a sudden a 18 wheeler Big Rig bumps into my rear and bam...bumper and tail light gone.

Now I get all the info and call my Insurance and gave them the info. Now my question is this, I need to get a car rental and my insurance told me to get a rental first and then they will get it from the other Insurer. Now I've seen Insurance companies put limits on daily coverage or time limits on the rental and I do not want to get stuck with the bill. Any sugeestions? Or good Lawyers here?

I am taking the car in to the Body Shop this afternoon and we'll see what the damage is and how long it takes to get it fixed!

Damn dude, sorry to hear that... and a rig AT THAT!

I would speak with you insurance company about the rental inquiry as they would probably best know how to advise in this situation... be sure to emphasize that the fault is that of the other driver and that they will be the ones paying for everything.

Let us know how it goes...

I don't live in the same state as you but when I got hit and it was the other driver's fault my rental car was fully paid for by the other driver's company for as long as I needed it. I had no problems at all as far as that went.

Who the hell is your ins comp? I guess if they are big enough you have no worries. You should tell the other ins comp that you want a "comperable vehicle"...if they balk, start rubbing your neck.

this ***** pulled over on me this morning on my way to work. She better be glad she didn't touch the Z. I gave her a nice looooong glare tho. I dont think she was aware that she did something wrong.

I have FArmer's but the Truck's Insurer is Van Breurden INsurance out of Kungsburg, CA. Anyone heard of them?

I got rear ended back in march.
The person's insurance company should cover everything.
You should have not went to your insurance company for nothing.
Her insurance covered my rental car, and the repairs on my car.

in cali you are entitiled to a comprible car....

if it is more then what your insurance covers the truckers insurance will re-emberse you..

I have a Honda Accord now...trying to get a Maxima when available. IN the meantime, I've ordered the Stillen rear wing and will add it as replacement to the OEM one. Will look nice once finished. PRelim estimates is over $ 3,300 to fix the damamges.

Sorry to hear about your accident.
I work for a trucking company, well for right now, got another job with an insurance company. Anyway. You should have gone to their insurance first, if they gave you the run around then go to your own. Its their fault, they should cover from day one regardless. Is your vehicle not driveable? That is our main issue here, we dont give rentals from day one unless the vehicle is not driveable.
You may have to pay your deductible until your insurance company gets payment from them or yours may waive that.
I would call your insurance company to make sure of the rental questions before getting one.
Dont forget about diminshed value. Check to see if you can ask for it in your state. Where you hurt?

What exactly is diminised value? How would I get it? Right now I am letting my Insurance compnay follow up with the Trucking co's INsurer. I have a witness and he made a statement that the Trucker rear ended me and I was not moving so I spoke to my Claims person and he told me to go ahead and rent the car. Afterwards, we will submit the bill along with my deductible and get reimbursed from the other company.

I did get a pinched nerve in my back from the accident so I also filed a medical claim too. Since I took a couple days off, can I get reimbursed for this from the other INsurer? (I am in commissioned sales so everyday I'm out, I don't get paid).

Diminished value is the diference between your cars pre accident value and post accident (repaired) value. Some states recognize diminished value and some dont. Illinois doesnt, so insurance companies dont consider it.

If injured, you can ask for pain & suffering, med bills, and lost wages from the responsible parties insurance company.

Hell, start rubbing your neck anyway!! Actually, since they were at fault the other ins co. should cover full costs for your rental. Whiplash usually takes a day or 2 to kick in so don't claim you're okay just yet. Since it's a commercial vehicle the company may wish to settle themselves rather than have their insurance pay depending on how many claims they've had. To bad about your car Good luck!!

Well, consider yourself a little lucky really.

Friend of mine was on a highway in rush hour, in his Jeep. He is stopped, looks in his mirror, and there's an 18 wheeler barreling down on him. It hits his jeep, he flies forward and hits the truck in front of him, then the 18-wheeler hits him again (it's hard stoppin' them things).

He had some minor whiplash, bruises, etc. But now, when he's walkin' you can tell one shoulder is higher than the other.

He's ok for the most part, just some back pain every now and then.

As far as your pay goes, you are entitled for lost wages but since you get paid on commission, you have to prove what you lost. Some times that is hard to document. You cant just pull a figure out of the sky and say that is what i lost, you have to document it.
