Default Got into a fairly bad accident last night in the Z :(

It all started off wanting to get some ice tea. I went out at around 11:00pm to get it from a local gas station. By chance I passed 2 friends, and then joined them. We decided to go to Rockville for a car meet. So we went down there, and a decent number of cars showed up. Well, cops showed up and asked everyone to leave. The cops here hate cars meeting up.. so I was casually leaving, when an Eclipse which I guess was new to the scene, and thought the police were going to ticket him, hits the gas making a left turn into the lane I was already in.

He seemed to be at WOT during the turn but I can't remember to well since I hit my head fairly hard on the glass. He took the turn fast and hard, stright towards me, I realized he was going to crash into me, I swirved to the shoulder but was still hit.

I honestly can say if I did not swirve to the side, I would have been hurt much worse. I am willing to bed my side airbags would have deployed.. but thankfully no one was seriously hurt. I'm injured in the sense 1, my head slammed my driver glass..and that my baby as now badly hurt

Also, the guy provided me with false information, only thing I have which I hope is real is his plates.. (he told me his license, insruance, and registration was in wallet, which he left home, and I can't search him, so had to take his word)..

Im also thiking about filing a law suit, but unsure if I should, since we were at a car meet and police had kicked us out. Not sure if that can impact the case.. I really am still in the shocked phase.. it only happened less than 10 hours ago .. Here is a quick pic...

If anyone who goes to the Rockville car meets, or lives in Maryland/Virginia/DC area and knows anyone who owns a car with the following on it, please PM me. This is the guy who hit my car and left me with false information.

95-99 Mitsubishi Silver Eclipse Bodystyle
I believe it's a GS-T model (turbo)

Lots of aftermarket, which include the following:

Aluminum Spoiler
Lowered
M3' Style Side mirrors with blue LED/turn signal built in
Large *** intercooler, guessing upgraded turbos
Exhaust system

Owner of the car is about 5'10, Hispanic, and weighs roughly 200-220lbs. He has a girlfriend who is about 5'5, Hispanic also, and curly brown(might be black) hair.

Because I'm a dumbass...

I was so caught up in all the emotions I was feeling, that calling the cops just didn't occur to me. I called my insurance 10 minutes later and filed the claim and they said they will get an investigator to figure out the situation though.

Could have been a lot worse, but it's still pretty bad... looks much worse in person. Since it was freshly waxed and sunny, the light really doesn't show the damage too well..

Finally, if anyone can help me figure out how to file a lawsuit, and what the steps to go through, please PM me. I want to file a suit, since I know the insurance company will payout, once the driver is proven at fault of the accident. (That is if I find the stupid fuc*er)

That is fokin TERRIBLE! I know you probably don't want to hear this Ricky..........BUT.......you should have DEFINITELY got the cops involved! Especially with the "lack of credentials this clown had or actually did NOT have!"

Hope everything works out for you bro'. I feel your pain....

Thanks TXSTYLE, I know I should have called the cops, but a few things did run through my head. First, if I did, we were leaving the meet, and the cops were trying to pull people over for trespassing the parking lot. I didn't want to get another ticket, or have anything involved at which I can by put at fault for anything..

I now realize how big of a mistake it was, but luckily I did talk to my insurance, and they will do their best to see what can be done to find the fuc*er. I have a few friends driving around Rockville right now seeing if peolpe know him... and also have a DMV friend running his plates, as well as the insurance company.


I'm trying to keep my head up by thinking...

"When I find this guy, I'm sueing his *** for atleast $10,000, and using that to get me some new 19" Volk GT-C's, maybe an ATI Procharger, and a nice sexy bodykit"... that thought is keeping my hopes up a little..but who knows what will happen now

sorry man, you should ALWAYS call the cops, even if its a tiny little hit, because the other person can say that you hit him and he is hurt and can sue you, and you have no proof that he is not telling the truch because there is no police record.

Shouldn't you just give the license info to insurance company and make them go after him?

I disagree.

1. If the accident is NOT severe (car able to move off the road).

2. No one is injured.

3. A person can (and people do) get sued all the time WITHOUT a Police report! They're good to have, but not neccessary depending upon the crash, particularly if you are rear-ended!

First of all if the above scenarios are the case, the call is gonna be a "low-priority" call for the Police.

I can say all of this because:

I was recently rear-ended. My wife and I were in the car, no one was hurt. The car was indeed drivable, and the individual admitted his fault we exchanged info, and my car was completely repaired whithin 2 weeks of this happening. And trust me, had the impact been sever enough to injur either one us, I would and could have easily sued his **** without question.

Also, I have a lawyer buddy who does only car accidents and he settles for people without reports.

yes but police have a habit of always getting the correct information for a kid. heh

alot easier to lie to you than "the man". if I had any thoughts that the guy wasnt being honest with me, Id get the cops out there for sure.

another bad thing about police reports is that it goes into carfax I believe, no police report, no record of the accident. cause when you get your insurance money it doesnt include the loss of resale value.

TXSTYLE, does he only do local representation or do you think he might be able to take my case? I'm not badly hurt, just a very sore neck and killer headache from hitting my head on the glass.

Also, I'm not sure how suing works when it comes to car accidents, do we actually go to court and battle it out, or, if his insurance concludes he was at fault, and I hire an attorny to sue, will they just pay out since he was at fault, and has insurance coverage?

I know my insurance paid out once when I was sued, and I never even know. My coverage was 100,000k/300,000k, and since I was at fault, my insurance just sent the victim a check for the amount I was being sued. Never even knew I was sued untill my insurance told me 2 years later.



I admit I should have called the cops, I wish I did, but you know how it is when you get into an accident, you're in so much shock, and have a billion and one emotions running, you don't think stright.. I wish I did call the cops, but I think I still have a fairly strong case since the damage on my car shows it's obvious I couldn't have been at fault, and ontop of that I have 2 witness's that are backing me up, 1 of which was a passanger.

Thanks for your concern and help guys... I need all the advice and support I can get right now. This is my first accident, and being 17, I really could use some experienced advice and suggestions.. Thanks to everyone.

sorry to hear this man.
Personally I would have called the police the second he said he didn't have his license on him.
If he was stupid enough to hit you I'm not suprised that he lied about his information

I disagree, you should call the cops no matter how small it is, they will probabbly send one of those community service patrols to at least make out a report.

Because even if you get his info, his insurance wont do anything unless the driver admits liability so if they decide to say it didn't happen or that it was actually your fault you have no report to prove it and you will have to resort to suing them.

your lawsuit is mute at this point, you have no documented proof of injury of any sort, youd need a medical write up showing your injuries, cause as it stands you have an accident then 2 days later you sue for pain and suffering with injuries that you never even saw a doctor for. you'd never win that.

Ricky-

Hey man, im sorry to hear about all of this! It definitely sucks... I remember days back at Metro, whenever the cops would come EVERYONE flew out of there, and I also witnessed at least 3-4 accidents exactly like your's. Some people get SO panicked when they see those lights, and just lose all self control or simply dont think about what they're doing. Well you know I come up to Rockville sometimes, and I'm ALWAYS out driving my baby around the VA/MD/DC area...so I'll keep an eye out for that Eclipse. Do you know where the guy was from? Do you remember if his plates were MD, VA, DC?? Just to be sure..hehe

Well Im only 20, never been in any serious accidents, so I can't offer much advice man. Sorry But I'm sure everything will be alright though man, and again the important thing is no one was seriously hurt, (including your baby) and dont worry...karma exists..so if the dude tries to get away with it, it will catch up with him

Goodluck with everything, i'll be on the look out for the Eclipse.

I'm so very sorry to hear of your accident and I truly hope you find the guy and the remedy you deserve. Really glad you were okay!!

Never can be sorry if you do call the police - you can if you don't. I know some state laws don't "require" it under certain accident conditions, however, there's no penalty imposed in being as protective of your own interests as you can. An official "police report" will say things then and later that simply word of mouth might change.

You know, I really HATE to make this into yet ANOTHER I told you so thread, but......

This is the SECOND teenager whose parents bought him an expensive car and it ends up wrecked, in two days.

Yes, I know technically, this didn't appear to be Ricky's fault, but would an adult have been hanging out in this potentially crash-prone situation to begin with? I mean, it isn't just the DRIVING part that takes RESPONSIBILITY here. It's the ability to AVOID potentially dangerous situations as well.

Also, the next time someone bitches about how high our insurance rates are, just read Ricky's posts about filing suit here. Sure he should get the car repaired at the insurance company's expense, but to SUE to get money for a SC for "pain and suffering" is ridiculous and simply emphasizes what is wrong with our society of victims today.

Agreed, Bonz. If I were retained by the insurance company for the idiot who hit Ricky, I'd make sure the jury read "I want a supercharger, maybe a cool bodykit out of this"; I'll guarantee they wouldn't give Ricky a penny more than what it cost to repair the damage to his car (and that money would go to Ricky's carrier if they already paid to fix his car).
