Sorry, well ... Not to write a book on it.
I got rear ended while completely stopped while going home from work. Car threw me forward a car length and hit the car in front, which miraculously wasn't damaged. Initially my damage didn't look as bad, but once the bumper was removed it was pretty nasty. My newly installed Borla was ruined. I had also finished installing my sound system and alarm earlier that week. I got some pretty bad whiplash and blacked out for a second...
Cop came and laughed at how the guy was screwed because it was 100% his fault.
Car in front of me left so he wasn't involved in the insurance claims.
2 weeks later I get a phone call saying sir, our appraiser totaled your car.
Well wont you look at that. I haven't had the car for a year to fully enjoy it. Lost my down payment money (most of it), and insurance is currently disputing hospital bills.

My TSX was rear ended by a NISSAN xterra, now I own a Z. Just get another one. Also, get a good lawyer. Squeeze that bmw for all its worth. And, go to the chiropractor and take some time off of work. Trust me.

especially if you did NOT go in the ambulance at the scene of the accident.

Are you still in any pain? People take others to court over nothing....you did him and the insurance the biggest favor you could have possibly done. I did it once as well...BMW ran a red light and did 7K worth of damage...I originally said I just want my car fixed but looking back at it now...I should have done more.

it's not too late to sue for injuries. whiplash injuries usually dont occur until a week or more after the accident.
but sucks to hear op. my san marino blue was rear ended by a hummer 3 months ago. the damage was not as severe as yours. total cost to fix was $9,700. im still going to the chiropractor as i have back injuries. i hired an attorney for the injuries and also hired a diminution adjuster for my vehicle resale loss of value.
what im trying to say is that you let the bimmer and their insurance go off way too easily. you could potentially have landed a pocketful of money.
im concerned that you may have back injuries looking at the damage.

While I don't really like the "sue-happy" approach many take in other areas, I completely agree when it comes to their carelessness while in control of a lethal weapon. Glad you're theoretically ok, but for something like that you should have gone to the hospital to at least get checked out.

Too late to sue for injuries if you didnt have an ambulance on scene take you to the hospital. Being that you blacked out, and possible had or have a concusion--You are CRAZY for not going to the hospital!

I still have a bit of neck pains, but after x-rays and cat scan the hospital said that thankfully there was nothing wrong and they gave me pain meds...
Their insurance offered more money then I owed on the car, therefore paying my loan off. $21k to be specific. I owed $19. The only issue was that since the guy's insurance policy doesn't take totaled vehicles unless it's insured by them so they deduct a salvage bid price off what they give you. Being that I go to work from 7 to 5 and school from 6 to 9:30 I wasn't having much time to consider every single option or path I could've taken. So I let my insurance take over the process since they take the car then just bill the other insurance for everything.
Before I get flamed or called an idiot, this is my first totaled vehicle, my first time dealing with insurance first hand, and I have never "sued" or used a lawyer for any type of lawsuit or claim.
But this information is good to know.
Being that this happened on June 14th, and we signed the insurance papers allowing them to receive the title from bank and pay off the loan, is there anything else that can be done?
I heard there are lawyers out there that don't charge you a think, but they only collect from what they earn, and if they don't earn anything they don't charge you.
I know very little about lawyers and the law.
