Default 350z 0-60 mph restriction?

So I was reading about how the 350z has a throttle restriction from 0-60MPH.
1. Is this true?
2. when you get your car tuned or reflash the memory with a programmer will it take it away?

Hypertech has almost perfect rating and reviews for their 350z programmer:

And it is supposed to get rid the the "Throttle Restriction."

it might be referring to the issue of the throttle plate not opening 100%.

The gradual opening rate of the TB is for smoother airflow response and doesn't limit power, tuning to remove it won't help any on a stockish car. If you have heavy airflow mods then the opening rate designed for stock components may want to be changed but it's not really slowing you down at any point.

Oh, well then I only have the K&N cold air, but I appreciate getting that cleared up.
