Possibly totaled 350z- Insurance payout?
The insurance company will most likely give you what the car is worth. Say they give you $17k but you owe $19k I would just total it out if you have the option and pay off your loan and take the loss and move on. Fixing it may lead to problems down the road and hurt your resale.

This is why I hate insurance. You pay crazy premiums for what ifs and when something actually happens they screw you.

One GOOD THING about StateFarm is that they will not total the car until damages exceed 70% and right now, even with them disassembling, I'm at 63% so I'm hoping I should be okay. The aftermarket invoices I sent in should at least raise the value enough to where if they're on the line about it that they will decide in my favor.
If not, I'll try bitching, women are awesome at that.
I was just trying to get some information incase things don't turn out the way I'm hoping and I had to start looking for a new car. =/

The biggest damage cost wise is the body that pushed in under the trunk area. Frame rails are fine, though.
Cracked radiator support, so I'd have to replace that whole stupid piece.
Other than that it's just a lot of cosmetic issues and an organ on the black market for some 06+ headlights.

Alicia, if they total the car and the payout will not cover the outstanding amount of the loan, check to see if your loan has gap insurance. Many banks will not extend car loans to young people without gap insurance. This will pay off the outstanding amount for you.
If they repair the car, look into a diminished value claim. Florida is a state that supports DV claims. Not a good as Georgia, which automatically compels insurance companies to pay DV on 3td party claims. Even if the repair is expertly done to Nissan’s standards, it will still carry the stigma of a wreck and its resale price will suffer. Getting a check out of State Farm for this will be like pulling hen’s teeth, but state case law is on your side. You will probably need to hire a certified car appraiser for a couple of hundred dollars to demonstrate the amount of DV. A web search will explain and suggest if this will be worth it for you. My guess is you might get about $900 in DV although I’m not in the US and have no idea of used car prices in your area.

hey what's going on, like some members say, your car damage doesn't look like 12k but you never know. I've been in a couple of accidents none of them were my fault but I always had a lawyer it makes things way easier you don't have to deal with anything. As far as your accident the one that rear ended you should pay for the whole accident, if you open a claim in your insurance it might go up. And as of the parts you had on it they one that rear end you should pay for everything doesn't matter if you didn't had coverage in your insurance. like I said get a lawyer if you want them to fix your car tell fix it and if you want it to totaled your car just let the lawyer know. My Z was totaled about 4 months ago (flood) it's a 05 base it had 80k miles. they have me 15k for it and bought it back for 1200$. sometimes you get lucky. sorry for the essay guys and good luck Alicia.

Good, for all the reasons discussed in this thread, I think you will come out a winner this way!
How much did you owe on the vehicle? Did they just agree to pay it off and you walk? Or did they pay it off AND will you get a check for enough to make a downpayment on something new?
On paper it is your fault. I disagree with it 100% but that is how it works. Whatever vehicle hit the damaged vehicle is liable, whether another car pushed that vehicle or not.
As I said, my aunt's car was parked, PARKED and she was liable for the car that her car hit. Of course the insurance company will fight the person who started the chain reaction to get compensated but unfortunately that is how it works.

If your aunt's car was hit while parked and she was found at fault, then you call her right after you read this and recommend that she find an attorney and check the statute of limitations on property damage claims in whatever state she lives in because she got royally screwed (which I don't think was the case at all and I think you have some facts wrong).

No offense dude, but you're completely wrong. I work in the industry and nowhere (and no competent adjuster) is going to place you at fault for being rear-ended and pushed into another vehicle. If you had rear-ended the front car first then were rear-ended by another vehicle, then you're at fault for the car in front of you and the car in back of you is responsible for your damages and possibly a portion of the front car.

In my aunt's case, the original car fled, so my aunt's insurance had to cover her car and the car that her's hit. Sorry I forgot to mention the fact that the person left, maybe that makes a difference?
