I am in the same situation. Bought a cancelled pre-order with the front plate installed. The bumper also has been damaged by the two other bolts for the plate. Right now the dealer said they will give me touch up paint. Thought about getting some plugs from www.bumperstops.com for the two bracket holes and see how the touchup works on the other holes. Do not know if it is worth fighting for since I did buy the car 'as is' off the showroom and the plate was already one.

Any thoughts?

It's a state law in NY also and my dealer did not install the front plate until asking me if I wanted it installed..Which I did not..

I asked my dealer NOT to install the front plate bracket. He said no problem and left it in the back of the car. Using 4 black ty-wraps, I mounted the plate directly to the grill. It fits perfect and I'm very happy.. I see no problem with the air intake and the temp gauge has been reading normal in 85 degree temps with the A/C on and in stop & go traffic.. I can't see why they MUST install the bracket.. It's a very cheap piece of plastic anyway.. I plan to mount the plate from a custom bracket connected to the tow hook fitting.. Should work fine..

Make the dealer fix HIS damage..

it won't happen, first of all you got a car off the showroom (as is), second, if it is a state law the dealer is obligated to do it, 3rd, it is NISSANS fault (not the dealers) that they didn't provide a better solution to mounting a plate without screwing up the bumper. I had the same issue with my wifes Jetta, some companies don't think about that stuff (my old Civic had threads built into the bumber and plugs for it to cover them up-color matched, my dads CLK55 has 4 holes as well it is like they just put 4 grabber screws in the bumper (literally) of a 75K car-amazing!!!

I would take the accesories

Again, it is NOT a "state law" that the DEALER put it on. Just that it be put on...presumably by the OWNER.

fight it. the dealer should ask you before they make ANY modifications to the car.
