Default getting screwed by kiet lau? anyone know him?

So around march 17 or so I paid this guy Kiet Lau (lives in soCal) (im not sure if he posts on here but i know on g35driver and freshalloy he does) for his 2k miles only stock track brembo kit. Basically He emailed me a week before the 17th seeing a post i had on g35driver on how i wanted these brakes and decided to email me saying he was getting a larger kit and was selling his brembos. I paypalled him on the 17th $2100. He did not respond till the beginning of the next week and so i got worried and put a paypal complaint against him. After clarifying a few things and talking on the phone with him it seemed as if he was just outta town for the weekend with his family for a family death, so i cancelled the paypal complaint. He said that he would send out the brakes by yesterday at latest because he was waiting for his stoptech kit who he ordered from Jason @ Performance to come in on the 9th. This is the reason why he was waiting because he didnt want to have his car 3 weeks without a brake set (the stoptech's come in the 9th of april)....he promised me he would email me yesterday with the tracking number and already had it packaged up. I got no email and when I tried to call him I get no response. The thing is i alrerady cancelled the complaint so I can't put another complaint against him to try to get my money back i dont think. I hope I'm not screwed, does ANYONE in here know him and or can help me out? HELP IS GREATLY APPRECIATED.

If you've paid, and get no merchandise, it's theft. You can file a report with the police. My hubby had a similar incident with some guy on E-bay, and it turned out that the guy had been scamming lots of people. He just took off. The Sherrif's dept was into it, and so was some big federal agency, as this had been going on for a while and they were following him to arrest him. Try him again, and if nothing go to the police.

worst comes to worst, send him a scary email, telling him he has X days to ship it or the police, fbi, etc will be notified etc etc.

Your probably screwed since you canceled your complaint. So your only option maybe to go through postal mail fraud, and that takes awhile and still doesn't mean you'll get your money back.

If nothing else works take a nice vacation and visit him in Socal. Youve got his address and I hear that Cali is nice this time of year

lucky bastard! Yesterday it was extremely windy, and cold. Plus I heard you dont get cicaydas (did I spell that correctly?) and this is the year they all come back

If your paypal was done with a credit card you still have a recourse path. They can charge back the billing once you fill out their dispute forms.

i would normally say be patient...cuz i tend to be a patient person myself. But this isnt chump change we're talking about, so that doesnt apply here.

I almost jumped the gun in bashing someone on here that I bought a part off of. I'm glad I didnt, because he truly is a good guy.

Just wait a few days. Feel secure that even though you used paypal (which is a horrible company in my opinion), that your paypal account is most likely secured with your credit card (hopefully not your checking account). Even if secured with your checking account, you can file a grievance with both paypal and the card/account that was used for paypal. Since you are not purchasing a virtual item and a tangible object that is traceable, you have the recourse of asking for a full refund or you can demand the product itself (if it is unique).

Also, if you cannot retrieve the product from the original seller, you can even buy another Brembo kit at whatever price and sue the original seller for the difference in price as well as the full refund of your original purchase.

Just make sure to keep a copy of your paypal receipt and any other correspondence you had with the seller.

Oh man Josh, sorry to hear that. I once had a dispute with a paypal and cancelled it when I was promised delivery. As you have found out, that probably ends everything. I can get you to cali cheap if you want to track him down though, let me know.

I think Jason is a regular poster on this board -- have you tried contacting him to verify this guy ordered the stoptech kit from him? Assuming there's no privacy regulations against him telling you...
