Who pays the deductable if you are not at fault in an accident?

Default Who pays the deductable if you are not at fault in an accident?

Was sitting at a red light when someone plows into a car behind me. The car ends up running into my rear bumper and tears a hole in it.

Is the first car responsible for paying for my insurance deductable?

If the first car is found to be at fault, that generally is the case. You will have to pay it first though, and your insurance company will reimburse you after they get the money from the other insurance company to cover the repairs.

What if both parties have the same insurance company? Which is the case here.

My insurance company waved my deductible on my last wreck because they are confident that they can get their money back due to it being a rear ending...

Maybe you can talk your insurance guy into that as well.

If the people at fault have plenty of insurance, then your company should feel pretty strong about the case....

I have USAA btw....

And here is my advice to you. There is NO reason for you to pay your deductible at all.

By the time you car is repaired and the shop needs their money, the insurance companies should have figured out who is at fault and that person's insurance should be billed directly. You just give the repair shop the name of the responsible insurance company and the claim number. They deal with the insurance for you. I have been in many accidents and that is always the way it works, otherwise it is a hassle for you.

Thanx for the input everyone.

She admitted fault so I should be cleared.

Been driving about 17 years and this is the first accident that required repairs...guess I have been pretty fortunate until now.

Usually get speeding tickets in 3's (2 in back to back days ...having a rough month...lol)...recently got a radar and bamm rear end...guess you can't fight destiny...lol

Agree with Yellow Stealth, you should not pay anything.

BTW, it may not be the 1st guy who will pay for your damages. It can be the poor guy in the middle. There are some stupid rules about that. I think the middle guy has to be able to prove that he is completely stopped before impact to be cleared. May be somebody else knows more about this topic.

If it's not your fault, you SHOULD NOT pay deductible. At least in MI they just wave it

Depends on what State you're in. In Fl, I was hit. I could have gone after his insurance company but I was positive mine would collect from his. I had to lay out the ded. but Geico returned it in full within weeks of the repair. I just didn't want to chase an out of the area insur. company around.
