Default NNA and San Rafael Nissan ... all planned out...

As some of you may already know, I've been in a legal battles trying to fight NNA regarding San Rafael Nissan shutting down.

Well latest news came out stating that NNA was the puppet master behind San Rafael Nissan shutting down.

You wanna talk about a small guy fighting against a big company like Nissan...I will win this case and Nissan will pay.

Initially we had no grounds for filing lawsuit against Nissan because there wasnt any evidence that NNA was behind all this. But slowly the evidences are floating up and NNA was the one that shut down the dealership and ripped off all the Nissan customers.

Thanks for keeping us updated, you might want to post a copy of this thread to the Northern California board as many members there are fairly acquainted with SR Nissan from having purchased cars there or have gotten service from them (many of the NorCal board members don't typically lurk outside of that forum too often).

Hmm, I don't frequent the Nor Cal board at all, but from the article (if it's accurate), I don't see how NNA is at fault. It seems like a logical course of action if the dealer owes a ton of $ for cars and isn't paying up.

FarSeide, you have been wronged, however, you're going after the wrong person(s). I'm positive that if my company didn't pay our vendors for our hardware and software licenses that total to 805k, then our vendors would repo their stuff.

You've also failed to read the bit that the court gave that dealership one last chance to pay off the debt before allowing NNA to repo their cars. That's right, the court allowed NNA to repo the cars. So if you're really going after NNA, then you should also go after the judge that let NNA do that.

So... are you really going after NNA because they have millions to pay out a settlement, or what?

I sincerely hope that you get all this worked out. It does seem though that the dealership is an independently owned and operated business (think of them as an authorized reseller) that has no affiliation to Nissan other than re-selling their products. The dealership doesn't sell cars for Nissan, they buy the cars from Nissan, and the resell them for themselves. Basically, the dealership is not an agent of Nissan.

It'll be interesting to see how this pans out for you though. Keep us posted.

One of my close family friends has been a car salesman for that past 30 years and told me that dealerships don't own the cars you see on the lot (except the used, trade-in cars), but rather the manufacturer does. If the cars don't sell too quickly, they're given to another dealer that needs more inventory.

Edit: This is as far as I know for the Mercedes Benz dealer in Pompano Beach and the largest Toyota dealership in Florida. It could be different for other dealers.

I agree with what the others have said, you are suing the wrong guy. You should be suing the owners of San Rafael Nissan, not Nissan.

If I were Nissan and the owners of San Rafael Nissan (Wisal Ameen and Majid Marhamat) owed me $800+k, I would be taking my cars back too. Based on the article you linked/provided, San Rafael Nissan was simply not paying Nissan for the cars being sold, so Nissan had to repo the vehicles.

I hope you get things straightened out and get your money back, I hate corrupt/unethical dealerships.

From what I read, it's not NNA's fault. If you're trying to sue NNA, you're throwing your money away.
