If I need to open or close the top while out driving, I'll pull aside to do it. If I'm at a traffic light, I usually arrive as it starts its cycle and I usually have more than the 20 second wait needed to operate the top.
According to my 2008 manual and as some mentioned above the top wont go down if you are above 3MPH, regardless if you have the break pressed down or not. Kind of a bummer though. I was hoping to reach the end of this article and find that someone made it work but then looked at my manual and found the speed part.

The soft top control unit has two speed inputs, one is an 8 pulse, the other is a 2 pulse. The service manual shows both as square waves, cycling between 0 and 12 volts at increasing frequency proportional to the vehicle speed. I'd assume the signal is at ground when the vehicle is stopped, but I'd probably put an oscilloscope on it just to be sure. You might be able to just cut the wires loose and let the inputs float, or you may have to ground them, or pull them to ground through a resistor. I'm not going to mess with mine, the soft top control module sounds like an expensive item to replace if I were to let the smoke out.
