Not sure if a repost.

Many of you have probably read about Ben Keaton on various forums, and his unfortunate accident.

Here's the latest, pretty sobering about life today. It's amazing how one mistake compounds.

Oh, there's SO much more to this incident than just one mistake... but at this point, thats for the courts to decide it looks like

yea.. this is really sad. but in the typical judicial system, she'll be set for life. this does seem to be a classic case of negligence.. among all parties. and well, to be found guilty under negligence.. the plantiff must:

a. show that the defendent (keatons) owed a certain duty to the plaintiff to act in conformity with a certain standard of conduct, or to act reasonably under the circumstances. going 150mph, being what seemed to be a novice driver, while complaining about the car being tailhappy.

b. the defendent breached that duty by failing to conform to the standard. ie. crashing.

c. a close causation exists between the plaintiffs injury and the defendents action. keaton crashed. dude died.

d. plaintiff suffered an actual loss. death of husband.

so yeah, we'll see how far this actually goes.

As I see it. If he determined the car was "defective" and drove it. He is at fault.

Yes, I couldn't agree with you more. The whole situation is very unfortunate for both families.
