Cool Strange situation need feedback

I haven't posted in a while because I was deciding on my Z and when I finally did here's what happened: I signed a lease contract in May for a new Z-$9000 down, 48 mos and 449/month-not that great. Then, I get a call 3 weeks ago that the contract's lost in the mail and I had to re-sign. I get another call a week later that the lease didn't go through. Meanwhile, the car's in my garage. I now have the option to finance the car but since it was already titled(I have the tags and regis to prove it and it's valid) to the leasing company that ultimately rejected the lease app, I'd have to get a B title and I'd be listed as 1st and second owner.
To compensate me, the dealer offered to sell me the car (roadster touring auto trans w splash guards, cargo net, etc. no nav) for $38000 plus a free extended warranty and the 2 months payments I made to the phantom lease company. Is this a good deal?
Or, the dealer will try to locate me a car with the same equipment and sell it to me for $38000 but no free warranty and I lose the 2 payments I made. I contacted an attorney and since I have had the car in my possession they can rightfully keep the 2 payments.
However, the dealer isn't looking too hard for the car I want since he wants me to keep the one I have. I know it's still possible to order one and that may be an option but when do the '08s come out?

Any feedback would be greatly appreciated.

This is an '07, right? Do they want you to finance $38K in addition to the $9K you already put down, or are you going to be financing $29K? If they want $38K minus your $9K down, I'd take the deal.

They want 38K total. The 9000 would go toward the downpayment on that. I just don't know if I should keep the car with the free warranty or just get a brand new car for the same price and no warranty.

The car was new when you got it right? I'd keep the one you have.

ya that lease was a bad deal to begin with. Sounds to me more like a fleece than a lease.

If the MSRP is higher than 39k and you are happy with it I would go for it. Otherwise I would just ask for my money back and start over.
