Default O.P.P Gave me a speeding ticket...

i wasn't really pay attention to my speedometer as i was so into talking to my friend and all of a sudden, the OPP showed up in my rearview mirror and pulled me over...

Got a ticket for speeding 110km on posted 80km road....in a small town almost 300 km away from toronto...$238 fine...

i didn't really care about the fine. all i care about is that the ticket is gonna affect my insurance rate..i am only paying 180 bucks per month for my 08 Grand Touring...as i have a very clean/good driving record.

i really don't wanna my driving record get ruined by this speeding ticket.

for the past 5 or 6 years of driving, i've never been pulled over

so this is my first ticket ever...

anyone has anyone recommendations?

should i go back to the small town and set a trial date?

do i stand a chance to win the case?

I had a ticket a few years back for driving 78 in a 50 zone. I hired an ex copper type dude to fight it for me. I think I paid him 150 -200 bucks.

Anyway he got the ticket dropped.

All tickets 49kms and under from the speed limit count as a minor ticket to insurance. The chances of your rates going up from one ticket are slim.

your rate won't go up for awhile, unless you switch insurance companies because its expensive for the companies to constantly refresh your drivers abstract. That being said, you're only going to pay higher insurance for 3 years anyway, on top of it only being a *minor* hit to your premium

You should always fight all tickets.

I would agree that you should try and fight all tickets... but sometimes (especially for those of us who are working professionals..) its just easier to pay the ticket, especially in a situation where it should not affect your premiums..

GL!

I looked up legal defences for speeding and I found this resource.

Simply play this video in court and you will get off with a warning.

The whole fighting tickets thing to me is rediculous... sure there are times when the ticket is legitimately argueable and by all means fight it. You broke the law and got caught, pay your dues and move on. I have had 2 speeding tickets and never tried to fight either. Nor am I ever a dink to the cop for pulling me over... I was speeding what should I expect? Not saying you were or anything, you sound like a humble person. But the people that freak out on cops because they caught them speeding it's like well... it's not like you didn't know there was a speed limit lol... you can only be mad at yourself.

I agree with you in theory....but in application, if we take two people who committed the exact same crime (speeding) and one gets off paying a nominal fee to a paralegal and the other gets shafted for the whole fine amount plus insurance increases....

which would you rather be?

fight it! you can plead guilty and they'll reduce it for sure. That way it will fall under minor offense for the insurance company.
And as long as you stick with the same insurance company, it won't effect anything. I had my license suspended and my car impounded this year... and my insurance went down 55 dollars a month this year.
But if I was to go get a quote with a new insurance company, they'd run a check and find out that my license was suspended.

Fine and dandy, from a legal perspective however allow me to hypothetically show you what may happen.

1. You got caught speeding, considerably. You decide to fight it because you are concerned your insurance premiums may rise.
2. You end up in a local court relative to the jurisdiction in which you were ticketed. given the area in which you were ticketed (rural, small town) i'm guessing they'll take the time to show.
3. Local judge, probably aged and frequently annoyed by sport car enthusiasts flying down 'his' highways.

Martyr. Then you'll have to pay plus waste time.

imo, pay it... you were clearly in the wrong.

nice... but, are all judges in rural areas aged, and annoyed by sport car enthusiasts?
i have gotten 4 tickets in the past 9 nears, and i've walked away 3 times and had 1 reduced (OPP).
I was doing 125 on the 407, went to court, pleaded guilty and they reduced it to 10 over.
One of the times with YRP, I walked away when Officer showed up, and the prosecutor decided to completely drop the 2 tickets he gave me.
I'm not saying this is ALWAYS the case but to just pay tickets in the Canadian system is not a wise decision because they're handing you an opportunity to have it reduced. All you have to do is get a court date, even plead guilty... and they'll still reduce it.

Your insurance will not go up for sure if you stick with the same insurance company anyway.

next to no one gets promoted to the bench before 50.. from a vague and general perspective, I would qualify that as 'old' heh.

125 on a highway... i'm surprised they didn't dismiss entirely.

I completely agree with you, you definitely should not undertake a blanket approach to paying tickets. However, 125 is a completely regularly acceptable speed on major highways, traditional roads traveling 25-30 over the speed limit is treated very differently.

130 in the left lane every day on the 401/QEW... haven't been pulled over once for it.

Highways are entirely different territories, flow of traffic is a factor... I am just taking in regional factors, you can definitely fight it, I just doubt it'll be worth the time in *this* particular instance.
