Body shop blues
Hey guy's I posted about a month back the small fender bender i was in.
Anyways, I have a question, hopefully someone can help me with.
On the quote from the insurance company is specifically states replacement Fender and side mirror OEM. I got my car back, the fender doesn't line up and the mirror isn't new, the mirror is a Nissan mirror, but off a wrecked car or soemthing. i wasnt given any kickback for the parts even though he bought used parts, or possibly not an OEM fender, since it doesnt seat properly.
Can I do anything about this?
Thanks!
Todd

yeah thats what i would have like to of done, problem is they completely botched my car, horrible.. i was scared to take it back to this shop, i have pictures of their work in case this goes to court.
i ended up taking it to another shop who did an excellent job on the repairs, but the fender still isn't lining up and im thinking the original shop used some knock off fender which is causing this.
my original plan was to pay the first shop for all the parts they purchased and they would have to eat the labor since it turned out like crap and i had to pay another shop to fix it correctly. now that im realizing they used scrap parts on my car, I'm going to have to purchase a new fender and have it sprayed and reinstalled which is going to be another 800$. after all is said and done im not going to have money left from insurance. sorry to them, but im not paying them out of my pocket because they didnt repair it right the first time.
im aleady covering about 200$ out of my pocket to get my car back to the way it was originally. on top of that the accident wasn't my fault.
thanks for your input, although its not what i was wanting to hear, lol.

I agree. If there is something wrong with the car you should never pick it up from the shop. You show them the mistakes right then and there so they cant make up any bs excuses about it not being like that when you left the shop. You should contact the insurance and let them know (that is if your insurance pays the shop directly or they pay you)
Yeah I pointed out several things to him while I was at the shop. It was raining that day and they had it stored in their shop with some flood lights on it. I noticed several things, but the lighting wasn't the best so I didn't notice some of the flaws until I got home in the sun light. The stuff I pointed out he blamed on too much clear coat, so he got some fine grit sand paper and started sanding the paint down, needless to say it was all scuffed/scratched after he 'fixed' it. I was so frustrated and mad (he was supposed to respray the whole front and back bumper), however when I got there he then told me he was able to blend both bumpers and didnt need to paint them. The blend was HORRIBLE!, I was so mad I was either going to kill him or break down and cry because I was so pissed. He had my car for two weeks, I had already returned the rental and had no way of getting home, so I just picked up the car and figured I would deal with this another day.
The insurance company did cut a check to me directly, so I ended up putting a hold on the check to the body shop. At this point, I think the guy is going to cut his losses. When I call he is too busy, he said he would call back, but if I didnt hear from him I should clal him again. Ok, so are you going to call or not? I'm the one that owes him money.

Here are a few pics of the blend and paint on the mirror (orange peel), also you'll notice they didn't remove the weather stripping before painting, just a failed attempt at masking it off. I have more, but just to give you an idea of the quality of their work.

Is it a major insurance company? Do they offer lifetime warranty if you go to an approved shop? If so you need to let them know so they will stop sending other people over there. It shouldn't be hard to get your repair fixed, it has happened to me a couple of times that I've brought the car home then noticed something. No problems at all getting Progressive to cover stuff like that.
Oh I didnt know you actually pointed out the flaws right then and there. And yes obviously you cant see every little detail until the car gets home and you see it in different angles etc. I think you should just not pay him and use that money and pay the other shop (which you did correct?) However, you should record your next conversation with him, or even if someone says they will call you back. It sounds like taking it to far but trust me I have been in this situation before and if it goes to court you will be happy you have it.
oh WOW that is a lot of overspray and a lot of orange peel. For the fender even if its oem it can sit like if he didn't straighted out all the metal on the frame and the brackets for that fender. Take that back asap. and for the mirror, tell them to wet sand the buff the hell out of that thing, lol. and tell them to rubbing compound that rear bumper with all that overspray.
a picture is worht a thousand words, should have posted them to begin with.
as of now, im 100% happy with the work the other shop did, im still up in the air with the fender though. the paint looks great, its just being off like that is really irritating me. the guy at the second shop said he did all he could to try and get it seated correctly, but it wouldnt line up and that was the best he could get it. that's why im 'thinking' it might not be oem, especially since the first shop bought a used mirror and tried to slide it by me. if the guy was honest and up front, that's a whole other story. hey im all about saving a few bucks if they can make it work and look as new. now spending 75$ on a mirror and pocketing the other 225$ ,then charging me 200$ additional to paint the rear bumper which looked WAY worse after he was done, is screwing me over. the rear bumper wasn't in the original quote, i was just getting it sprayed because it had a litttle nick, nothing as obvious as this!
i appreciate all your guys' comments, ill update the post with any updates.

i tried working with the insurance, BUT since i chose the shop they basically wiped their hands clean. i learned a valuable lesson, ALWAYS use an approved shop through the insurance co, otherwise the shop has no accountability to them.
