Default Damage to Rear Spoiler

Hey guys, just got my car back from a shop and when i got home i instantly noticed that my rear spoiler had a wide, deep scratch that wasnt there when i dropped it off. The shop is claiming they didnt do it, and i know for a fact it wasnt there when i dropped it off because i detailed it the previous morning. Ive got a 2007 Nismo, so im sure that wing wont be cheap to fix. Any ideas short of taking the shop to court? Although im not sure how far i'd get there even though i have a few witnesses that could vouch it wasnt there when i dropped it off...

you didn't do a damage report prior to leaving the vehicle? tisk tisk

sorry to hear this happen again to someone.
really going to be a waist of your time. leaving the place and then discovering the damage after driving 40million+ miles home, could be 500 feet home, the distance is irrelevant.
going to hard to make it stick without reasonable doubt once the car has left the premises.
just to emphasize a point they could say in their defense,
an leprechaun riding a miniature unicorn could have flown by and trampled your spoiler on your way home after leaving the shop.
and a judge and jury could find it plausible even though its ridiculously impossible.

just fix it, dont go back and in future always do a damage check when dropping off and before leaving when picking up.

watch judge judy, witnesses are about as helpful as being trapped in an alligator pit with a styrofoam cup as your only weapon, unless you are mcguyver then i think you'd be out of luck.

you didn't follow procedure to watch your own back and unfortunately it will be very difficult to get them to pony up..

i understand I'm at fault for trusting one of the leading performance shops in my area, a mistake which i wont make again. However, that doesnt help my current situation. Oh well, its just money, right?

it sucks, but aside from informing you of how to handle it next time, there is little we can offer.

drop it off, take pictures at drop off, inspect thoroughly on pick up, discuss any new damage before taking the vehicle from them, take pictures of the damage etc.

it sucks needing to be this picky with shops, but as you can see, even a leading performance shop will not want to pay for damage they may or may not have caused (no way to prove it)

definately the shop at fault for damaging your car. just stating what could have been done to help you "prove your case"
on the bright side it could have been worse...case and point...took my t/a car (91 honda civic) to a shop for an engine swap.
swap was clean and proper BUT I got the car back without my lsd.
even though I know & countless others know it had lsd.
couldnt prove that it was taken out by the mechanic/shop cause I didnt find out it was gone till a meet the following month after getting the car.
from a third party point of view...i could have taken it out within that month and trying to pull a scam on the mechanic/shop.
now i double check and triple check everything.
trust me when I say, lesson learned.

Thats a multi peice wing too... it has to be taken apart to be properly painted.
