Default Issues with top coming completely down to windshield

I have a 2007 350Z Roadster and a few weeks ago I was on the highway and the latch popped unlock and top flew up. Now as shown in the attached pictures, the front of the top when closing does not come all the way down to the windshield like it used to and makes it impossible to lock without two people pulling it down. I can't see any obvious bends in the frame, but that is probably my assumption. Any tips or fixes to get it to come down farther?

Why would a mechanical failure be covered by insurance?
