it seems that i got sent the wrong pop charger kit for CN. the heat shield is totally off. did a comparison online and it totally doesnt match. and the fact that the directions has G35 kinda hints to me that its the wrong kit. my question is.. can this still be used for the 350z and do i have to use the heat shield?

Without the heat shield I'd say you're better off with the stock intake. In fact at least 2 tuners I've talked to have said the stock intake consistently makes the most HP on the dyno.

But if you want to install without it, be my guest, you won't hurt my feelings.
