Default Stock air box/ Injen tube.....will this work??

OK,
I got tired of the stupid injen air filter because I smashed it when I was trying to clean it. I also realized that my gains were neglible, so I decided to make a hybrid stock air box with the injen tube. The problem with doing this is that the hose that runs under the intake tube connects to the stock tube after the MAF, however, the injen intake has the tube before the MAF. I didn't know what to do with the stupid tube, but I did notice that it had a vaccuum when the engine is running. I purchased a K&N breather element filter and simple attached it to the end of the tube. I have the tube loosely mounted beside the factory airbox. I went to the dealer today and they said that the tube is a PCV tube and that what I was doing would not be smog legal. They also didn't like how the injen setup put the inlet for the tube before the MAF. Anyway, would anyone please be able to comment if what I did will work or should I just go all Injen or all stock????? I know these CAI threads have been beat to death and they all produce minimal gains. That's the main reason I went back to my stock airbox with K&N drop in. Thanks peoples.
