Rear brakes don't fully disengage

First off, I have an 08 with Brembo brakes and only about 9400 miles on the clock so it's still under warranty and definitely going back to the stealership. But before I go, I just want an idea of what is wrong.
I've noticed recently that when braking, I can hear the pads scraping against the rotor on the back brakes (which may be completely normal). But once I take the foot off the brake and either coast or gently accelerate, I can still hear the pad scraping against the rotor (definitely abnormal). I have not done any brake work or modded the suspension, wheels, or tires at all nor have I hit a curb or pothole.
So what's the dealio and what can I tell the stealership when I get the inevitable "problem cannot be duplicated so go screw yourself" answer?

The piston presses the pad against the rotor. When you release the brake peddle, the pad cross spring returns the pads. One or more of the cross springs is not working properly.
OR one or more of the pistons is not returning properly.
Oh I forgot: OR brake fluid is not returning properly to the master cylinder causing the piston to lag and the pad to drag.

So I called the stealership's service department and set up an appointment for Saturday. On a side note, the tech on the phone was very polite at first because he thought I was signing up for an overpriced oil change but once he found out it was a low margin warranty repair, he attitude did a 180 and became short and brusque.
Anyway, he told me more than once the usual "if we can't duplicate the problem, we won't do anything so screw off" so once I'm done on Saturday, I will post the results then.
