Damage is less than 4K...getting fixed now. should be ready before xmas. Drivng a pos rental Focus.

Be sure to put in a claim for diminished value as well as the repair. If they say no, tell them you're going to lawyer up.

How much could the diminished value be.............$1000? No lawyer is going to take a case like that on a contingency basis. The original poster would spend more than that on the lawyer's hourly rates.

Since you did an insurance claim it will come up on carfax. Being that it was in a wreck the value of your car dropped a few thousand on resale.

Since the wreck wasn't your fault you shouldn't have to take that financial hit so that's why you should file the DV claim.
