Got assaulted in DC. Need a lawyers advice!

Default Got assaulted in DC. Need a lawyers advice!

Ok, this is the story.

Last Sunday (Easter!) I was walking down with my girlfriend on 14th Street in NW DC (where Noah lives) . Out of the sudden this super wasted guy pops out of nowhere and starts to look at me aggressively, cursing in Spanish (he was not Hispanic though). I and my girl are not looking for any trouble so we are just looking ahead and keep walking. Unexpectedly, this guy approaches me and punches me straight in the face.
What a kind of person attacks the guy on crutches who can barely walk on Easter evening?????
. Anyway, we’re trying to get away but the guy doesn’t give up. Tries to follow my girlfriend, but she runs away. So the dude follows me since I’m slower. Comes to me with his fists up. At this point I only had one decision to make: let him hit me again or do something.
So, I drop my crutches, punch him straight into the face and jump on him to get him on the ground. Keep in mind that my leg is in the cast healing from ankle surgery. When he falls and his head hits the pavement I try to hold him so he’ll not try to fight back.
Then we call cops.
It turned out that the same guy attacked someone 10 minutes earlier and cops were already looking for him. Apparently, he decided to assault someone again.
Half freaked out, half laughing we file a report with the officer.

Here’s my question: Should I get a lawyer and sue him for an assault? Any legal advice will be appreciated.

You should have beat the living $hit out of him with your crutch... or had your girlfriend do it.

Chances are a person of that level of society is not going to have much to offer even if you do sue. You are probably better saving your money...

+1 on above, I wouldnt even bother suing him. Did you try telling him to get away or did you just try to ignore him and walk away?

No sweat, this is an obvious self defense case. You could sue but you'd be wasting your time, he'll use the excuse of "I was drunk and didn't know what I was doing blah blah blah". Besides lawyers get most of the money anyways. Then again, I'd be embarrassed to say I got beat up (if I was the drunk guy) by a guy in crutches, which I personally would've used to beat the living drunken **** out of him.

That's horrible! I agree w/ the other posters that you probably won't get anything out of suing him for assualt (and battery), but you should def. press charges and follow the criminal case. In the event you learn he does have assets, then follow-up with a civil action.

Well, it was definitely not the average bum. Guy had a nice clothes on and Treo 650 in his hand......

Even if I can't get any money out of it, I'm going to court to find out who this guy was and screw him!

Dude, you have got to write a book or something! I mean, really: the bad juju is just unending, innit? Glad you & your girl are safe, but I agree with those above who say suing is futile. God knows what this guy's story is, and even though he had a Treo, chances are you'd get nothing but heartache outta taking him to court. Again, glad you guys are OK. Now it's time for your luck to change for the better—you have totally earned it!!!!!

Yeah i work in D.C. and i can tell you there are quite a few people there who are mentally challenged. I can't tell you how many times I walk across people who are yelling at an invisible person beside them or who are cursing at people in their cars for no reason. i mean they stop in the middle of the crosswalk and just stand there yelling at cars.

happy to hear you are doing alright and it didn't escalate to anything more serious. watch yourself out there in D.C. bro. even for dudes, it's a good idea to maybe carry some pepper spray or something if you are gonna be in D.C. at night walking around.
