The only thing I would disagree with about the open container thing would be if it was completely out-of-reach (like in the trunk) then they shouldn't be charged but if it's in reach, there should be no excuse.

WOW thats Fcking mind blowing $700+ Thank god I have been driving the speed limit. What really F'ing irritates me is even if you drive the speed limit you constantly have to keep changing lanes to let other a$$wipes fly by you, 66 bites now.

I got a reply from one of our Loudoun County state Senators. It seems Delegate Tom Rust was the Chief Architect of adding the "Abuser" fee.
Mr. Coughlin:
Thank you for your email regarding the abusive driver fees that were included in the recent transportation bill. I read Delegate Tom Rust's response to your original email and noticed he left out the background information on how these fees were originally added to the Transportation Plan. By way of background, Delegates Tom Rust and Dave Albo were the chief architects of the abuser fee provision that was included at the insistence of the Republican leadership.
However, I continue to believe that the transportation bill overall is a victory for our region. Northern Virginia traffic is not just an inconvenience, it is something that hurts our quality of life and hinders our economic development. Now, for the first time in 20 years we have a transportation plan to help address our transportation crisis which generates $1.5 billion in new revenue for the state and $500 million in new funding for Northern Virginia. It allows local control over spending of money raised in Northern Virginia and gives our counties the power to charge developers impact fees to help cover the cost of road improvement projects. That said, I am not comfortable with certain aspects of the transportation bill – particularly the fact that the abusive driver fees do not apply to out-of-state violators – and we will work on correcting it during the next legislative session.
In the District I represent, this bill will fund construction of the Route 28 parallel roads such as Atlantic Boulevard, fulfill the state’s share of building new interchanges on Route 28, extending Battlefield Parkway between Route 7 and Kincaid Boulevard, and improve the Leesburg Bypass. Virginia needed to make a commitment to improving our transportation, and given the choice between providing some money to solve our transportation problems and no money, I chose some money and look forward to going back in the next session and correcting the less desirable portions of the bill.
I appreciate your concern and input about the bill, which I will keep in mind when I go back to the General Assembly to address this issue during the next legislative session.

State Senator Mark Herring seems like a stand up guy. Here's his response to my reply.
Mr. Coughlin:
Thank you for your email response. I agree, the improvements on Route 28 have made the commute of many residents in your area much better, and they will continue to improve as we complete construction on new interchanges at Nokes Blvd., Innovation Ave., Willard Rd, and Frying Pan Rd. I have seen the online petition and I can tell you that addressing these fees will be one of my top priorities in the next legislative session.

Senator Herring:
Thank you for your response. I will say that I'm very pleased with the recent interchange additions to route 28. My commute has been nearly cut in half since additions have been made. That being said, I sincerely hope when you go back to the Genereal Assembly these "Civil Remedial Fines" will be at the top of your list. Just to let you know, I'm not the only VA resident that is upset with these new fines. An online petition was started about a week ago and over 90,000 Virginia residents have already signed it. http://www.petitiononline.com/va3202/petition.html
