Now to take someone elses recording of Cannon in D and remix it into your own song, you'd be taking someone elses work. To rerecord the song on your own and use it, you'd be ok.
So for Kung Fu stuff, either it was rerecorded and slightly tweaked to get around copyright issues, or they got permission/paid. Keep in mind, asking permission doesnt always mean paying. It puts an old song in the spotlight again.
As for not asking.....
Ghostface Killah is being sued for illegal sampling on his sophomore album, Supreme Clientele.
According to The Hollywood Reporter, distinguished film and TV composer Jack Urbont has filed a lawsuit against the Wu-Tang Clan star, Sony Music Entertainment and the Rza’s Razor Sharp Records for sampling the “Iron Man Theme,” which Urbont wrote for 1966 animated television series, The Marvel Super Heroes.
The suit alleges that Ghost “copied verbatim” Urbont’s “Iron Man Theme” on two Supreme Clientele tracks and “fraudulently concealed” this use by failing to acknowledge Urbont’s composition in the liner notes.
Though the album was released in 2000, the complaint cites Urbont’s “recent discovery” of the illegal sampling and copyright infringement, and asks for damages dating back to the album’s initial release.
Urbont – whose credits include theme music for That ‘70s Show, Oprah, 20/20 and The View, as well as soap operas like Guiding Light, One Life to Live and General Hospital – also takes issue with Ghostface’s nickname, Tony Starks.
“Defendant Ghostface is also known for the nickname, ‘Tony Starks,’ which is a take-off of the name ‘Tony Stark,’ Iron Man’s real name and true identity,” the complaint says. “In this way, Defendants’ use of Urbont’s ‘Iron Man Theme’ gives them a substantial commercial advantage by linking Ghostface to Iron Man without paying for it.”

Can I have an honest answer on the whole Shin thing:
So Shin takes a sampling of something from youtube (song, choir like voices, whatever). Something that someone made but didnt add "rights" to. He then takes that and puts it into a beat he has made using a computer program. He then takes what he has made, adds his own "rights to it" (adding a voice over or whatever). Finally he takes this "package" and sells it for money on you tube. But it is now his, because whatever sampling was done was from stuff that someone else didnt assign rights to?
Im not being an ***. I just want to follow along with what is going on.

As for copyrights. As soon as you record a song, you own the rights to that song. Even if you don't submit it for Copyright. If someone else uses it, you just need to be able to prove without a doubt that you wrote it first. If you can prove it, then you'll have 20 lawyers lined up ready to take the job for free (if whoever used it hit it big)
When someone like Shin takes music, it's a lost cause due to no money but if theres enough money changing hands. Like in wu tangs case, we're talking millions and millions of dollars.
It could mean a 10-25-50 million dollar payout with no up front money for a lawyer.

Did you know, it was illegal to do mixed tapes back in the 90s? People always made mixed tapes and gave them to GFs/BFs and such. Yes it was illegal. It never really became a problem because there was no money involved.
Did you know it's illegal to download any song that isnt listed as open to public? Or are you one of those guys that has 10GB Of mp3s that got passed around? Or is it ok because you're not selling them? Only slightly tweaking them and then using them for your own music. But its ok because it's not "commercial".

If you alter a sample so that an average listener cannot hear any substantial similarities between your work and the sample, there's no violation of the law.
Factors in determining fair use. Generally, when reviewing fair use questions, courts look for three things:
•You did not take a substantial amount of the original work.
•You transformed the material in some way.
•You did not cause significant financial harm to the copyright owner.

Taking a string rift, tweaking it and making it sound very different, yes no problem.
Directly cutting/pasting from one to the next.... again, its iffy.
I point this stuff out to keep you from getting sued one day, but as always you don't give a F because your friend is the LAW.
P.S where did it say anything in there about mixed tapes VS commercial?
I thought they both had their own rules?
