ok, update.
I called back my insurance and this time I talked with the right girl and she was a lot more cooperative with me and she explained what I have to do and what I can do. the other party insurance was nice too.. tomorrow they'll come to take the pictures of the damage than I can drop the car in the shop (I guess).

Sorry to hear about the damage. That sucks. Which body shop are you going to use? I would do a lot of research before just having the "dealer's shop" do it. Even if it takes longer, get it done right the first time.

Matteo: sorry about the car, man. It looks like it should be good as knew when the bumper is replaced.

A word of advice: don't sign ANYTHING from the insurance company until AFTER your car is fixed.

I'm waiting the guy from her insurance.. his coming today to take pictures and than decide who's the "guilty" one... and if they'll pay or not... maybe it's time to warm up my lawyer, just in case!

Not sure if Texas is a non-at-fault, but if it's not, then the smart thing to do would be to go through the lady's insurance company so that you won't have to eat the deductable. If they give you any issues, then go through your company so that they can pay you and let them worry about getting the money back from the other company.

I talked to my insurance and that is exactly what they told me... If I'm going to have issues with the other, they'll take care of everything, run the investigation again and work with me getting back the money.
my deductible is only 500$, so it's not an issue, especially if will come out that some connectors, supports, pads are broken under the bumper cover.

dude, from the pics that looks like no damage at all. get a new bumper and call it a day

it'll take you 1 hour max to take off the bumper, 25 mins to put back on.

looks like that... I'm not concerned at all.. the structure is fine and that is just replaceable "plastic".. I just don't like to pay 1.5K for something that is not my fault and have to loose time with all the bs.

*edit* the insurance rep did come to take picture of my car, looks like the nice lady version of the story don't match with mine.. so they will investigate on that... anybody knows how long usually takes? back impact for her while she was backing up, side impact for me standing.. is not so hard to figure it out.

I guess that lady really disliked the Nismo rear!

I'm kidding! No need to send an assassin after me. Sorry to hear about the accident.

that lady would dream about having a sexy rear end like the nismo one!

and I have a damn update. looks like into a parking lot... I'm screwed. If I use my insurance and they (actually I) loose.. it's going to cost me 500$ deductibles, 1800$ in 3 years of raised premium (I'm a "young driver" in the states) and a claim on my insurance... so what the lady suggested me... officialy use the insurance, they are there for that.. unofficialy don't use it, take a defensive driving class and have my premium reduced by 15% for 3 years.. at that point I'll get back the money twice... I didn't know about defensive driving to lower insurance rate.
it's a kobayashi maru.
