Default 2008 Nismo Rear Ended

Leaving work today, I was entering US HWY 19 N. 4 lane road, with a 5th lane at times for turns (as you can see by the Google photo and my horrible drawing)
Basically, I start going one lane at a time till I get to the Turn lane, looking in my rearview mirror, my left side mirror and looking over by tuning to the left before I move into each lane. As I am almost completely in the turn lane, I press in the clutch and put my gear into Neutral and relax, then 1,2 and BAM! I get hit, the car goes a little left, I turn hard right, while breaking and pressing in the clutch instinctively, I ride the curb and up doing a 180 and facing on coming traffic and raise the Emergency Brake to make a stop, I probably was going around 30MPH in the turn lane and ended up sliding a good 150-200 FT.

It was pretty crazy, here is also a photo of the damage I took with my BB.

Couldn't see any damage underneath, the car started and drove but the left sode Exhaust pipe is loose.
What a horrible day, at least no one got hurt.
The guy said I moved over to the lane to fast and that he hit me in the Fast Lane not the turn lane, it just didn't make sense to me based on the skid marks I saw, but it's all speculation as no witnesses stopped.

it's really difficult to prove that he is at fault because by law, I have to yield to on coming traffic, but I did yield, I think he was speeding and not paying attention too much, coming out behind a car into the Fast Lane as I was just entering the Turn Lane (hence the reason why he hit my car on on the left side pretty much, because my car was at an angle entering the Turn Lane) then he saw me and he didn't have time to brake and hit me.

The TT is awesome, but I just hope everything will be fine with it when they check everything. Boy this SUCKS

I can tell you right now that you need a new bumper for sure.
Mine was hit from behind, and just had visible scratches, no dents,
or major damage. The shop replaced the whole bumper.

That totally sucks man. I hope everything turns out alright. Not sure if I would cry or punch the guy out. Sounds like he is at fault IMO. Good luck IB!

IB... So insurance? Anyone get ticketed? Did you get the other drivers
insurance info? In general you can get an FHP trooper or sim to side with
you if you're reared. Sorry to see your car in such a state.

Thanks Dozzi!
Florida is a "No Fault" state, so our Insurances pay for each other and then go to figuring out whos fault it was to recover their money. The biggest thing I have going against me is that the guy who rear ended me works for the pinellas county. Yes I got a citation, which really sucks, but I am going to go to court for it.

Careless driving, I couldn't believe it, it's like they just had to give someone something, and they gave it to me. Shop said it's $3100 worth of Damage and should be done in a week.

Lol I know how you feel. My brother got broad sidded in an S2000 because a guy pulled through a stop sign without looking left because a guy taking a turn onto his street was waving the car on. Car was totaled, wheels flew off and the whole bit. (S2000 cabin was untouched however +1 to Honda quality)

My brother was driving my fathers car at the time and went straight to the hospital after(but was fine). We get a citation in the mail a few days later faulting my brother for speeding even though there was nothing to prove it except the other guys word(young kid/anyone in sports car = looks bad compared to getting hit by a lexus 600 or whatever that boat was).

I thought my brother was going to put his fist through the wall. Then the police report came in and said my brother hit the guy pulling out. He looked like this when get got this one

After weeks of arguing using this crazy thing called common sense, while describing the pictures which showed my brothers car had all side damage and no frontal damage (proving in fact he did not hit the car, but the car hit him, which had no side damage and all frontal damage). We finally got reimbursed for the car.

Good luck to you and try not to kill anyone in this process. You are dealing with the laziest of the laziest when it comes to these insurance people. So call frequently and ***** often

Good news out of all of this is you didn't loose any limbs. Imagine if you lost a leg!!! you would be forced to drive..... an automatic!!!

Thanks Lento! Actually my brother was in a pretty bad accident some years ago in hi STI, he was lucky he didn't have any serious injuries either.
At the moment all I have to pay is a deductible, $500, after our insurances take care of our cars they will go to battle after who was at fault to recover their money. My biggest issue here is the citation, no witnesses stopped, no cops were on scene during the accident and I get a citation
I was the one that was rear ended!
I will set a date for court to fight the citation and hope it works out, I don't want 3 point and pay $140 for something I didn't do!

I have found a small loophole which I use regularly.

About two years ago I decided to handle one
accident "differently" -

I was rear ended, damage to rear bumper, and collected
other drivers insurance information. Immediately called the
agent listed, stated that the insured struck me, and that
there was damage to my vehicle. Demanded a shop address
for repairs, which I was given. No sense in subrogating the
claim imo. ALSO... EVERY time you use your insurance, regardless
of fault, your insurance company considers each incident
your fault. Hence forth from that point forward, (living in
Miami accidents are a bimonthly incident) I demand the accident
causing drivers information and handle as stated above. I
do not notify my carrier. To each his own, but frankly I don't
cause accidents and have never been ticketed for anything
aside from speed violations, and do not want to get played
by the no-fault system...

Sorry to hear Aleksey, US19 is NO JOKE. I seriously don't understand how you got a ticket when YOU got rear ended. I though anyone who rearends another is automatically at fault It's obvious the other guy wasn't paying attention, and if he couldn't react in time he was speeding. Good luck bro and see ya at The Run...
