You should be ok with that. Most 255's 35/40 require a 8.5-10" rim, with 9" being nominal. A 9.5 will stretch the tire a bit, but you shouldn't have any problems. I have a 265/35 on a 9" rim and the sidewalls are straight up and down.

I'm running 18's. I have not noticed anything different about braking or ABS.

255 on a 9.5 is just fine... just make sure you check the tread width

*actual* tread width on a 255 ranges anywhere from ~8.4 inches to ~9.6 (s03's I believe are the widest 255)

don't take the rated spec for granted, always check the actual tire width, you can find this on almost every manufacturer's website

best example? a dunlop sp9000 275 has less tread width than a bridgestone s03 255

If you go to Tirerack.com and look under products, then select a tire brand, then select spec, it will show you how wide your rims need to be to accomodate the tire and tread width.

I have 255 Toyo's on my 9.5's and they are a little too small for my tastes. I think i'm going to step it up to 265 and see how that looks.
